of 9 April 2014

amending Annexes II and V to Regulation (EC) No 1223/2009 of the European Parliament and of

the Council on cosmetic products

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (1), and in particular Article 31(1) thereof,

Whereas:

(1) Entry 25 of Annex V to Regulation (EC) No 1223/2009 specifies a maximum concentration of 0,3 % in relation

to the use of triclosan as a preservative in cosmetic products.

(2) The Scientific Committee on Consumer Products (SCCP), subsequently replaced by the Scientific Committee on

Consumer Safety (SCCS) pursuant to Commission Decision 2008/721/EC (2), adopted an opinion on the safety of triclosan for human health in January 2009 (3), followed by an addendum of March 2011 (4).

(3) The SCCP considered that the continued use of triclosan as a preservative at the current maximum concentration

limit of 0,3 % in all cosmetic products is not safe for the consumer because of the magnitude of the aggregate exposure, and the SCCS confirmed this position. However, the SCCP considered that its use at a maximum concentration of 0,3 % in toothpastes, hand soaps, body soaps/shower gels and deodorants, face powders and blemish concealers is safe. In addition, the SCCS considered that other uses of triclosan in nail products where the intended use is to clean the fingernails and toenails before the application of artificial nail systems at a maximum concentration of 0,3 % and in mouthwashes at a maximum concentration of 0,2 % are safe for the consumer.

(4) In light of the SCCS opinions mentioned above, the Commission considers that maintaining the restriction on

the use of triclosan at its current level would raise a potential risk to human health. The additional restrictions suggested by the SCCP and the SCCS should therefore be implemented in Annex V to Regulation (EC) No 1223/2009.

(5) Entry 12 of Annex V to Regulation (EC) No 1223/2009 specifies a maximum concentration of 0,4 % for single

ester and 0,8 % for mixtures of esters in relation to the use of parabens as preservatives in cosmetic products, under the denomination 4-hydroxybenzoic acid and its salts and esters.

(6) The SCCS adopted an opinion on parabens in December 2010 (5), followed by a clarification of October 2011 (6)

in response to a unilateral decision by Denmark to ban propylparaben and butylparaben, their isoforms and their salts in cosmetic products for children under three years of age based on their potential endocrine activity, taken in accordance with Article 12 of Council Directive 76/768/EEC (7).

(7) The SCCS confirmed that methylparaben and ethylparaben are safe at the maximum authorised concentrations.

In addition, the SCCS noted that limited or no information was submitted by industry for the safety evaluation of isopropylparaben, isobutylparaben, phenylparaben, benzylparaben and pentylparaben. As a result, for these compounds, the human risk cannot be evaluated. Therefore, those substances should no longer be listed in Annex V and, given that they might be used as antimicrobial agents, they should be listed in Annex II to make clear that they are prohibited in cosmetic products.

(8) The conclusions the SCCS drew in the same opinions on propylparaben and butylparaben were challenged by a

study carried out by the French authorities (1), therefore a further risk assessment of those two substances was adopted by the SCCS in May 2013 (2). Measures on propylparaben and butylparaben are under preparation, as a second step in the risk management of parabens.

(9) No concerns were raised on the safety of 4-Hydroxybenzoic acid and its salts (calcium paraben, sodium paraben,

potassium paraben).

(10) The relevant annexes to Regulation (EC) No 1223/2009 should therefore be amended accordingly.

(11)The application of the above-mentioned restrictions should be deferred to allow the industry to make the neces-

sary adjustments to product formulations. In particular, undertakings should be granted six months to place on the market compliant products, and 15 months to stop making available on the market non-compliant products after the entry into force of this Regulation, in order to allow existing stocks to be exhausted.

(12) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on

Cosmetic Products,

HAS ADOPTED THIS REGULATION:

Article 1

Annexes II and V to Regulation (EC) No 1223/2009 are amended in accordance with the Annex to this Regulation.

Article 2

From 30 October 2014 only cosmetic products which comply with this Regulation shall be placed on the Union market.

From 30 July 2015 only cosmetic products which comply with this Regulation shall be made available on the Union market.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

欧盟化学品分类、标签及包装法案

欧盟化学品分类、标签及包装法案 欧盟通过一项关于化学物质和混合剂分类、标签及包装的法规议案。新法规修订第67/548/EEC号指令、第1999/45/EEC号指令及第1907/2006号法规。新法规对化学物质的分类及标签的准则或责任做出规定,填补了REACH法规具体化学物质分类及标签内容的缺失,并与其相辅相成,共同构筑欧盟抵御危险化学品的绿色壁垒。20l0年12月1日依照本法规对物质进行分类;于2015年6月1日对混合物进行分类,现行的相关法规、法案、指令拟从相应的过渡期结束后予以废止。 新法规重点对化学品分类的方法、要求及时间限定等进行了解读。标签方面,须提供供应商的名称、地址和电话,可以识别物质或混合剂的资料、危害标志、危害声明、提防声明,以及有关危害的补充资料。 该提案与联合国全球化学品统一分类和标签制度(GHS制度)和我国现有化学品 分类和标签体系存在较大差异,将对我国化学品行业造成影响。该法规与GHS 及我国于2008年1月1日正式实施的以联合国GHS制度为基础的《化学品分类、警示标签和警示性说明安全规范》系列标准(GB 20576-2006~GB 20602-2006)具有明显差异。由于分类体系的不同,该法规的实施将会涉及REACH相关要求的修订,增加REACH的实施难度,势必进一步对我国化学品贸易产生巨大冲击。 10.1 CLP法规与欧盟现有化学品分类和标签制度的区别 欧盟是当前世界上对化学品控制和管理体系最为完善的区域,欧盟通过立法体系、管理体制、主要制度等对化学品实施了有效的监管。 欧盟现行的化学品分类和标签制度 第67/548/EEC号指令:危险物质分类、标签和包装要求; 第1999/45/EC号指令:危险配制品分类、标签和包装要求; 第91/l55/EEC号指令:安全数据表要求,该指令则确保了物质和配制品的供应商向职业消费者提供化学品的危险信息及安全使用指南。 欧盟REACH法规第11篇规定了化学品分类和标记目录的有关要求,将上述三项指令纳入其中,要求注册者以上述三项指令为依据,按要求向化学品管理局通报相关信息,并根据化学品的危险类别对其采取不同的管理措施。 新法规与现有法规相比,最大的差异主要表现为:危害类别、判定阈值及标签要素不同;涉及的物质条目大幅增加,与原法规相比新增条目896种;增加了更多混合物分类的要求。 10.2CLP法规与GHS制度之间的差异

欧盟化妆品法限制多种物质的使用 欧盟《官方公报》于2009年2月5日刊登新的欧委会指令(2009/6/EC),对第76/768/EEC 号化妆品指令作出修订,禁止2种物质(其中1种只允许微量存在),并容许使用3种物质,但受若干条件所限。第2009/6/EC号指令将须于全部27个欧盟成员国实施,于任何一个成员国销售化妆品的贸易商均须符合新规定。 根据欧盟化妆品法,「化妆品」由任何物质或制剂构成,与人体多个外部(包括皮肤、头发、指甲、嘴唇和生殖器外部)或牙齿和嘴接触,专用于清洁、散发香气,改变外观,辟除体味,以及保护有关部位。第76/768/EEC号指令附件1胪列化妆品清单,其中包括用于皮肤的乳霜、乳液、化妆水、凝胶及润肤剂、肥皂、防臭剂、香水、头发或指甲护理产品、美白和抗皱护肤品,以及口腔护理产品等。 欧盟的「化妆品成分清单」列有二甘醇(DEG)这种物质,它具有溶剂功能,可控制黏度,并有遮盖作用。2007年7月,西班牙政府通知欧委会,他们发现牙膏产品含有浓度高达8.3%的二甘醇。欧盟消费品科学委员会认为,在化妆品中使用二甘醇会构成危险,但浓度不超过0.1%应属安全。因此,新化妆品指令将二甘醇加入附件2(附件2列举一般禁止用于化妆品的物质),同时把二甘醇纳入附件3(附件3列举在特殊条件下获准使用的物质),允许化妆品含有不超过0.1%微量的二甘醇。 维生素K1是维他命K的一种,具凝血功能,也是护肤品的成分之一,作局部外用,如改善黑眼圈或增加皮肤光泽。法国已禁止含有维生素K1的化妆品,因为该国的一项研究发现维生素K1令人产生过敏反应。维生素K1遂被纳入化妆品指令附件2,禁止用于在欧盟市场出售的化妆品。 甲苯是一种溶剂,用于指甲产品,被列为致癌、诱变或危害人类生殖力的第3类物质,原因是甲苯可能对未出生儿童造成损害。根据有关禁止危险物质的欧盟法例(第76/769/EEC 号指令),浓度高于0.1%的甲苯禁止用于胶水及喷漆等公众用产品。不过,从一般毒理学角度来看,指甲产品中含量不超过25%的甲苯被视为安全,但应防止儿童吸入甲苯。因此,甲苯被列入化妆品指令附件3,最高允许浓度为指甲产品含量的25%,但产品必须附有警告标签,说明产品必须存放于儿童接触不到的地方,以及应只供成人使用。 法国限制化妆品使用二乙二醇单丁醚(DEGBE),最高浓度上限为9%。二乙二醇单丁醚用途广泛,除用作染发料溶剂外,还用于油漆、染料、油墨、去垢剂及清洁剂。在欧洲,近60%二乙二醇单丁醚用于清洁剂,约35%用于油漆及表面涂层。根据消费品科学委员会的推论,第2009/6/EC号新化妆品指令将二乙二醇单丁醚加入附件3,成品中的最高允许浓度为9%,但禁止二乙二醇单丁醚用于喷雾器(如喷发定形剂)。 用作染发料溶剂的乙二醇单丁醚(EGBE)也列入附件3,其使用须符合浓度上限,氧化染发产品为4%,非氧化染发产品为2%。乙二醇单丁醚与二乙二醇单丁醚一样,禁止用于在欧盟市场销售的喷雾器。 所有欧盟成员国最须于2009年8月5日或之前将第2009/6/EC号欧委会指令转化为本

冬天给你的最深感觉,是不是肌肤的过分干燥?了解一下保湿化妆品的成分和功用,对你来说一定有所裨益。人的皮肤有天然的保湿系统,由水、天然保湿因子(NMF)、脂类三种物质组成。我们现在使用的保湿化妆品是对这一体系的模拟,保湿品的主要成分是水、保湿剂和油脂。 化妆品中常见的保湿剂包括: 甘油:是最古老的保湿剂,十年前,很多人直接用甘油加水护理冬季皮肤。安全,价格低廉,是 含量最大最普通的保湿剂。 透明质酸(HA):是人类皮肤中天然固有的保湿成分,它保持水分的能力比任何天然或合成的聚合物都强因为价格很高,添加量一般不大。 神经酰胺、胶原蛋白:是近年来开发出的最新一代保湿剂,由于它们和构成皮肤角质层的物质结构相近,能很快渗透进皮肤,和角质层中的水结合,形成一种网状结构,锁住水分。因为它保湿的原理不同于传统的保湿剂,有人说它开辟了保湿的新天地,可是同样由于成本太高,不作为保湿的主要成分,添加量极小。 尿素:是皮肤天然新陈代谢的产物,对软化皮肤作用奇佳,很多润手霜中都含有尿素。 甲壳素衍生物:是从甲壳纲动物外壳中提取的天然保湿剂,效果和透明质酸接近,是生理上十分安全的保湿剂,此外它还作为药物用在人工皮肤和创伤愈合方面。 芦荟:植物性的保湿剂。由于芦荟汁含有粘多糖(类似于透明质酸),故有很好的润滑和保湿作用,此外还有防晒和消炎的作用。 海藻提取物:海藻是世界上最古老的植物,无根、无花也无果。富含氨基酸、维生素和粘多糖,对皮肤有保湿,润滑和防皱的作用。 化妆品中常见的油分则有: 凡士林、白油:是从石油中提取出的矿物油,保水效果好,安全,但透气性差,令皮肤有一种被“糊住”的感觉。价格低兼,是中低档保湿品大量使用的油分。 霍霍巴油:取自西蒙得木果实。主要成分是不饱和高级醇和脂肪酸,有良好的稳定性,极易与皮肤融合。日本化妆品对霍霍巴油简直到了痴迷的程度,多添加在高档化妆品牌中。 小麦胚芽油:它取自小麦胚芽,其中VE(即生育酚)的含量非常高,是优质润肤剂。欧洲化妆品厂家喜欢采用,多加在高档化妆品牌中。 角鲨烷(深海鲨鱼肝油):角鲨烷大量存在于深海产的鲨鱼肝脏中,是少有的化学稳定性极高,使用感极佳的动物油脂,还可抑制霉菌的生长。 硅油:上世纪七八十年代发展起来的新一代油脂,稳定性可以和凡士林媲美,并具有良好的抗静电性和透气性,使皮肤能够自由呼吸,是各个档次保湿品普遍采用的油分。 羊毛脂:羊毛脂和皮肤的亲和性非常好,可在皮肤表面形成轻度吸着的光滑膜,是很好的柔软剂。但有的羊毛脂略有异味,如果添加量大了,还要加大量香精,对它的气味进行掩盖。 保湿能力强的多是含油分多的膏霜类产品,但要记住保湿能力不是越高越好,这取决于你的皮肤类型。从这个意义上讲,保湿品无所谓好坏,只要是感觉舒服,它对你来说就是最好的,而不要在意价格是昂贵还是低廉。

欧盟最新食品安全法规与应对 管恩平 欧盟是我国最重要的贸易伙伴,是世界上食品安全管理最为严格的地区之一。近几年来,欧盟不断对其食品安全管理体制进行改革,并出台了大量与食品安全相关的法律法规和标准,成为世界上食品安全体系运作最成功的区域之一。为此做好对欧盟最新食品安全法规的学习培训与应对工作,对于保障我国食品农产品出口贸易的顺利发展具有重要意义。 一、欧盟与欧盟法规概括 (一)欧盟扩张与发展 自欧共体成立以来,先后经历了8次扩大,成员国从最初的6国发展到目前的28国。 从欧共体成立之初,欧共体的成员国数量为法国、联邦德国、意大利、比利时、荷兰和卢森堡等6国。 1973年1月1日,英国、爱尔兰与丹麦加入欧洲三大共同体。1976年1月1日,希腊成为第十个成员国。1986年1月1日,西班牙与葡萄牙加入,使欧共体成员国增至12个。1995年1与1日,瑞典、芬兰与奥地利加入欧盟,欧盟成员国数量扩充到15个。2004年,波兰、捷克、斯洛伐克、匈牙利、爱沙尼亚、拉脱维亚、立陶宛、斯洛维尼亚、马耳他、塞浦路斯等10国加入欧盟。欧盟成员国数量增至25国。2007年1月1日,罗马尼亚和保加利亚正式成为欧盟成员国。欧盟拥有27个成员国。克罗地亚于2013年7月成为欧盟第28个成员国。 (二)欧盟组织结构 1、欧洲议会(European Parliament),是欧盟的立法、预算、监督和咨询机构,代表各成员国人民的意愿,议会成员由选民直接选举产生,任期5年。主要权利为:部分立法权;预算决定权,与欧盟委员会一起决定欧盟的年度预算;民主监督权等。 2、欧洲理事会(European Council),最高决策机构,也称为“欧盟首脑会议”、“欧盟高峰会”或“欧洲高峰会”,是由欧盟28个成员国的“国家元首”或“政府首脑”与欧洲理事会主席及欧盟委员会主席共同参加的首脑会议,欧盟外交与安全政策高级代表也参与欧洲理事会活动,主要职责是商定欧盟发展方向的重大问题,它是欧盟事实上的“最高决策机构”,欧洲理事会无立法权。 3、欧盟理事会(Council of the European Union),俗称“欧盟部长理事会”,由欧盟各成员国部长组成,又称"部长理事会",简称"理事会"(the Council),是欧盟的重要决策机构。欧盟理事会负责日常决策并拥有欧盟立法权。 4、欧盟委员会(European Commission),是欧盟的常设执行机构,也是欧盟唯一有权起草法令的机构(除条约规定的特殊情况外)。根据《里斯本条约》从2014年起,欧盟委员会的委员人数将从29名减至18名。欧委会主席人选由欧洲理事会一致同意提出,经欧洲议会表决批准。欧委会成员由欧洲理事会指定并经委员会主席同意,再经欧洲议会表决并批准授权后才可就职。欧委会的具体工作由总司承担。 (1)健康与消费者保护总司(DG SANCO)

<< 常见化妆品有害成分分析| 首页| 英文/中文护肤品成分对照表 >> 控油成分 2006-07-28 https://www.sodocs.net/doc/0612785618.html,/logs/2927263.html 常见的控油成分 1.收敛剂(Astringent)——收敛毛孔,但无法做到真正控油 老旧的控油产品会以无机粉体作为收敛毛孔成分,这一类成分的作用,类似于用木塞堵住漏水的水龙头,对出油的毛孔来说,无真正控油的价值,长期使用还会造成皮肤的负担,肤质变差,油光依旧。 典型的老旧成分:氧化锌(Zinc oxide)、硫酸锌(Zinc sulfate)、氯化铝(Aluminum chloride)、硫酸铝(Aluminum sulfate)等。 同样属于收敛毛孔的成分,目前较常用的新成分为有机酸类。这一类成分副作用少,收敛效果较明显,可以在短时间里感觉到毛孔变得较为细致。 典型的新成分:单宁酸(Tannin, Tannic acid)、柠檬酸(Citric sc id)、乳酸(Lactic acid)。 2.清凉剂——只能瞬间收缩毛孔,效果不持久 清凉剂主要为酒精与薄荷,两者都有瞬间收缩毛孔的功效。但这种清凉效果只能治标,也就是说,在很短的时间后收敛效果即会消失,无法有效控制后续冒出的油脂。 此外,酒精对皮肤尤其是细胞膜具渗透去脂能力。对于酒精含量过高的控油产品,不论哪一类肌肤,都应审慎思考长期使用可能造成的负面影响。 3.维生素——主要针对因脂漏性皮炎而出油的人

以维生素作为油脂调理成分,主要对象为因缺乏维生素B6而造成脂漏性皮炎的人。换言之,并非所有油性皮肤的人,使用含维生素B6 的控油产品都会有效。对于患有面疱的油性皮肤,且经常伴随发炎现象的脂漏性油性肤质,选择搭配维生素B6、维生素B3与维生素H的控油产品,较能得到治本的效果。 4.荷尔蒙 过油的皮肤导因于男性荷尔蒙分泌过剩,所以含药化妆品可以使用低剂量的雌性荷尔蒙作为控制剂,以便有效控制皮脂分泌量。常见应用的成分为雌二醇(Estradiol)、雌固酮(Estrone)、乙炔基雌二醇(Ethyn ylestradiol)。另外,化妆品厂商也从植物中发现部分植物性荷尔蒙具有抑制雄性荷尔蒙转化的机制,例如南瓜素(Cucurbitapepo)。 口服荷尔蒙疗法的适用对象是面疱型肌肤,也就是又油又长青春痘的人才适合选择这一类商品。单纯只是油光满面,不论是化妆品生产商,还是皮肤科医生,都不建议服用荷尔蒙来控制。 5.角质剥离溶解剂(Cormeocyte desquamating agent) 最典型的角质剥离溶解剂是水杨酸,其次就是AHA果酸了。水杨酸对于毛孔中的角质栓塞溶解效果最好,但会造成皮肤变薄且十分干燥。所以,不是因毛孔阻塞的面疱族,只是一般型油性肌肤的人,并不适用这种控油成分。 但是,目前市面上有超过八成以上的控油产品以水杨酸作为控油的主成分。更惨的是,使用水杨酸配方者,还喜欢搭配高浓度的酒精。这真是苦了消费者的脸蛋,因为太多人错以为水杨酸既可以控油,又可以收缩毛孔。其实,再高浓度的水杨酸也无法改善可以煎蛋的油脸,却足以毁掉皮肤的防卸机制,使皮肤变薄、偏干、偏敏感

欧盟REACH(《关于化学品注册、评估、许可和限制制度》)简介 什么是REACH “Registration,Evaluation,Authorization and Restriction of Chemicals,化学品注册、评估、许可和限制”,是欧盟对进入其市场的所有化学品进行预防性管理的法规。将于2007年6月1日正式实施。 REACH的目的 保护人类健康和环境;保持和提高欧盟化学工业的竞争力;增加化学品信息的透明度;减少脊椎动物试验;与欧盟在WTO框架下的国际义务相一致。 从实质意义上讲,REACH法规将促进化学工业的革新,使其生产更安全的产品,刺激竞争和增长。与现行复杂的法规体系不同,REACH将在欧盟范围内创建一个统一的化学品管理体系,使企业能够遵循同一原则生产新的化学品及其产品。 REACH的主要内容 注册(Registration)年产量或进口量超过1吨的所有化学物质需要注册,年产量或进口量10吨以上的化学物质还应提交化学安全报告。 评估(Evaluation)包括档案评估和物质评估。档案评估是核查企业提交注册卷宗的完整性和一致性。物质评估是指确认化学物质危害人体健康与环境的风险性。 许可(Authorization)对具有一定危险特性并引起人们高度重视的化学物质的生产和进口进行授权,包括CMR,PBT ,vPvB等。

限制(Restriction)如果认为某种物质或其配置品、制品的制造、投放市场或使用导致对人类健康和环境的风险不能被充分控制,将限制其在欧盟境内生产或进口。 注:PBT 持久性、生物富积和毒性化学物质 vPvB 高持久性、高度生物富积化学物质 CMR 致癌性、诱变性和生物毒性物质 REACH制度影响对中国出口贸易的影响 一、影响产业范围广:除了对化工企业有直接影响外,REACH将对包括纺织、机电、玩具、家具等所有的生产化工下游产品的企业产生影响,所涉及的产品有100多万种。 二、企业出口成本大大增加:据欧盟估算,每一种化学物质的基本检测费用约需8.5万欧元,每一种新物质的检测费用约需57万欧元。 三、要求的数据量大:REACH要求提供化学品安全数据表、安全评估报告、风险评估等一系列的注册档案技术文件,涉及的数据量复杂庞大。 REACH注册流程图 注册Registration 要求年产量超过1吨的所有现有化学品和新化学品及应用于各种产品中的化学物质注册其基本信息。只有通过注册的物质才能在欧盟内生产或进口。 每一个物质的生产商和进口商须向化学管理署提交该物质的注册档案,并缴纳相应的费用。但是要求联合提交同一个物质的注册信息,即遵循“一个物质,一次注册”原则。作为联合注册的成员,可以与其他成员共同分摊注册的费用。 为了易于管理、接受大量注册档案的提交,提交给化学署的注册档案需电子化处理。化学管理署会给每一个收到的注册档案一个注册编号和注册日期,并立刻把这些信息传递给注册人。

REGULATION (EU) No 168/2013 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 15 January 2013 on the approval and market surveillance of two- or three-wheel vehicles and quadricycles (Text with EEA relevance) THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, and in particular Article 114 thereof, Having regard to the proposal from the European Commission, After transmission of the draft legislative act to the national Parliaments, Having regard to the opinion of the European Economic and Social Committee ( 1 ), Acting in accordance with the ordinary legislative procedure ( 2 ), Whereas: (1) The internal market comprises an area without internal frontiers in which the free movement of goods, persons, services and capital must be ensured. To that end a comprehensive EC type-approval system for two- or three-wheel vehicles was established by Directive 2002/24/EC of the European Parliament and of the Council ( 3 ) on the type-approval of such vehicles. Those principles should continue to apply for this Regulation and the delegated and implementing acts adopted pursuant to this Regulation. (2) The internal market should be based on transparent, simple and consistent rules which provide legal certainty and clarity from which businesses and consumers alike can benefit. (3) With the aim of simplifying and accelerating the adoption of type-approval legislation, a new regulatory approach has been introduced in EU vehicle type- approval legislation, under which the legislator in the ordinary legislative procedure sets out only the funda -mental rules and principles and delegates the laying down of further technical details to the Commission. With regard to substantive requirements, this Regulation should therefore lay down only fundamental provisions on functional safety and environmental performance, and empower the Commission to lay down the technical specifications. (4) This Regulation should be without prejudice to measures at national or Union level regarding the use of L-category vehicles on the road, such as specific drivers’ licence requirements, limitations of maximum speed or measures regulating access to certain roads. (5) Market surveillance in the automotive sector, and in particular the L-category vehicle sector, should be improved by enhancing the legal provisions governing conformity of production and specifying the obligations of the economic operators in the supply chain. In particular, the role and responsibilities of the authorities in the Member States in charge of type-approval and market surveillance should be clarified, and the requirements relating to the competence, obligations and performance of the technical services that perform tests for vehicle type-approval reinforced. Compliance with the type-approval and conformity-of-production requirements of the legislation governing the automotive sector should remain the key responsibility of the approval authorities, while market surveillance may be a competence shared between different national auth -orities. Effective coordination and monitoring at Union and national levels should be deployed to ensure that approval and market surveillance authorities apply the new measures effectively. (6) The national authorities’ obligations laid down in the market surveillance provisions of this Regulation are more specific than the corresponding provisions of Regu -lation (EC) No 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products ( 4 ). (7) This Regulation should contain substantive requirements for environmental protection and vehicle functional safety. The main elements of the relevant requirements of this Regulation are based on the results of the impact assessment of 4 October 2010 carried out by the Commission analysing different options by listing possible advantages and disadvantages in terms of economic, environmental, safety and societal aspects. Both qualitative and quantitative aspects were included in that analysis.
