海关的职能
依据本国(或地区)的法律、行政法规行使进出口监督管理职权的国家行政机关。(英语Customs一词，最早是指商人贩运商途中缴纳的一种地方税捐，带有“买路钱”或港口、市场“通过费”、“使用费”的性质。这种地方税捐取消后，Customs一词则专指政府征收的进出口税，the Customs是征收进出口税的政府机构，即海关，是对出入国境的一切商品和物品进行监督、检查并照章征收关税的国家机关。
各国政治、经济情况不尽相同，海关职责也有差异，即使同一国家，各个历史时期海关职责也有变化。但以下几项职责是绝大多数国家海关基本相同的：①对进出口货物、旅客行李和邮递物品、进出境运输工具，实施监督管理，有的称作通关管理，有的称作保障货物、物品合法进出境。②征收关税和其他税费。许多国家海关除征收关税外，还在进出口环节代征国内税费，例如增值税、消费税和石油税等。有些国家海关，还征收反倾销税、反补贴税和进口商品罚金等。③查缉走私。各国海关部对逃避监管、商业瞒骗偷逃关税行为进行查缉，尤其对走私禁止和限制进出境的货物、物品，特别是毒品，每一个国
家海关部加大查缉力度。其他是部分或个别国家海关具有的特殊职能：如编制对外商品贸易统计、保税管理、沿海巡逻警戒、管理航行一级保护版权和专利权等。21世纪初，有些国家除对传统的有形贸易(实物)监管外，还对无形贸易(服务贸易)进行监管。许多国家政府指令该国海关履行国际出口管制制度，即对高科技产品、导弹技术产品、核相关双重用途产品、生化武器、常规武器、环境污染物质和有毒废料、濒危物种、文物等进行管理制。
根据《中华人民共和国海关法》规定，中国海关职能有4项：监管、征税、查私和编制海关统计。
进出境监管
监管进出境的运输工具、货物、行李物品、邮递物品和其他物品;征收关税和其他税、费;查缉走私;编制海关统计;办理其他海关业务。
中华人民共和国海关是国家的进出境监督管理机关，实行垂直管理体制，在组织机构上分为3个层次：第一层次是海关总署;第二层次是广东分署，天津、上海2个特派员办事处，41个直属海关和2
所海关学校(上海海关学院和秦皇岛海关学校);第三层次是各直属海关下辖的562个隶属海关机构。此外，在布鲁塞尔、莫斯科、华盛顿以及香港等地设有派驻机构。中国海关现有关员(含海关缉私警
察)48000余人。目前，共有国家批准的海、陆、空一类口岸253个，此外还有省级人民政府原来批准的二类口岸近200个。
中国海关总署依照《海关法》规定，对进出境运输工具、货物、行李物品、邮递物品和其他物品进行监管。2003年，全国海关共监管进出口货物164254万吨，进出境运输工具2292万艘(辆、架)，进出境集装箱4410万标箱，同比分别增长1.6 %、3%和26.4%;监管进出境人员23259万人次、邮递物品9657万件、快件5359万件。
查缉走私
法律规定，海关是查缉走私的主管部门。中国海关总署为维护国民经济安全和对外贸易秩序，对走私犯罪行为给予坚决打击。中国实行“联合缉私、统一处理、综合治理”的缉私体制，海关在公安、工商等其他执法部门的配合下，负责组织、协调和管理缉私工作，对查获的走私案件统一处理。1999年组建的海关缉私警察，是国家打击走私违法犯罪活动的主力军，按照海关对缉私工作的统一部署和指挥，负责对走私犯罪案件的侦查、拘留、执行逮捕、预审工作，综合运用刑事执法与行政执法两种手段严厉打击走私。2003年，全国海关共查获走私案件12939起;立案侦办走私罪嫌疑案件12816起，案值100.8亿元;上缴罚没收入21.3亿元;对3090名走私犯罪嫌疑人采取了强制措施。同时，全国海关坚决查缉毒品、文物、武器弹药、濒
危动植物和反动、淫秽、盗版、散发性宗教宣传品等走私违法犯罪活动，积极配合有关部门开展打击骗汇、骗退税、制售假冒伪劣等经济犯罪的斗争，为维护国家经济安全和社会稳定作出了积极贡献。
编制海关统计
根据《海关法》规定，编制海关统计是中国海关总署的一项重要业务。海关统计是国家进出口货物贸易统计，负责对进出中国关境的货物进行统计调查和分析，科学、准确地反映对外贸易的运行态势，实施有效的统计监督。中国海关总署按月向社会发布中国对外贸易基本统计数据，定期向联合国统计局、国际货币基金组织、世界贸易组织及其他有关国际机构报送中国对外贸易的月度和年度统计数据，数据发布的及时性居世界领先地位。中国海关总署定期编辑出版《中国海关统计》月刊和年鉴，积极为社会各界提供统计信息资料和咨询服务。
征税
海关税收是国家财政收入的重要来源，也是国家实施宏观调控的重要工具。根据法律规定，中国海关总署除担负征收关税任务外，还负责对进口货物征收进口环节增值税和消费税。2003年，全国海关征收关税和进口环节税净入库达3711.6亿元，比上年增收1120.95
亿元、增长43.27%。1998年至2003年，全国海关征收各种税费净入库达13713.48亿元，为增强中央财力作出了重要贡献。
