Decree No. 344 of the State Council of the People’s Republic of China

Regulations on the Control over Safety of Dangerous Chemicals have been adopted by the

52nd Executive Meeting of the State Council on 9th January 2002.

We hereby issue these Regulations, which shall take effect as of 15th March 2002.

Chapter I General Principles

Article 1 In order to strengthen the control over safety of dangerous chemicals, to guarantee the people’s life and property safety, and to protect the environment, these Regulations are hereby enacted.

Article 2 Production, operation, storage, transportation, and use of dangerous chemicals and disposal of the wasted dangerous chemicals within the territory of the People’s Republic of China shall be governed by these Regulations, laws and other administrative regulations of the State on production safety.

Article 3 “Dangerous chemicals” as referred to herein include explosives, pressure gas, liquefied gas, inflammable liquid, inflammable solid, spontaneous combustible articles, combustible materials in case of moisture, oxidants, organic peroxide, toxic articles, corrosives, etc.

Dangerous chemicals listed onto the List of Dangerous Articles (GB 12268) promulgated as the national standard, the catalogue of hyper-toxic chemicals, and other dangerous chemicals not listed onto the List of Dangerous Articles shall be determined and announced by the administrative department in charge of comprehensive management of economy and trade jointly with the administrative departments in charge of public security, environmental protection, health, quality control, traffic control, etc of the State Council.

Article 4 The personnel chiefly in charge of units that manufacture, deal in, store, transport, and use the dangerous chemicals and dispose of the wasted dangerous chemicals (hereinafter referred to as the “units of dangerous chemicals”) must guarantee the safety control for their own dangerous chemicals satisfy provisions of the relevant laws, regulations, and rules, as well as requirements of the national standards, and be responsible for the safety of their own dangerous chemicals.

The personnel engaging in the manufacture, operation, storage, transportation, use of dangerous chemicals or disposal of wasted dangerous chemicals of the units of dangerous chemicals must take part in the training for the relevant laws, regulations, rules, safety knowledge, professional skills, vocational safety protection, and emergency knowledge. Only those passing the examination may hold their posts.

Article 5 The relevant departments in charge of supervision and administration of the manufacture, operation, storage, transportation, use of dangerous chemicals, and the disposal of the wasted dangerous chemicals shall fulfill their responsibilities according to the following provisions:

(1) The administrative department in charge of overall management of economy and

trade of the State Council and the administrative departments of economy and trade

of the people’s governments of provinces, autonomous regions, and municipalities

directly under the Central People’s Government shall, in accordance with these

Regulations, be responsible for the overall work for the supervision and

administration of safety of dangerous chemicals, be responsible for examination and

approval of the establishment, reconstruction, and expansion of enterprises that

manufacture or store dangerous chemicals, be responsible for the examination and

appointment of the professional manufacturing enterprises of packing materials or

containers (including trough containers used for transportation, hereinafter inclusive),

be responsible for issuance of the licenses for operation of dangerous chemicals, be

responsible for registration of domestic dangerous chemicals, be responsible for

organizing and coordinating the emergency rescue for the dangerous chemical

accidents, and be responsible for the supervision and examination of the aforesaid

matters. The administrative department in charge of the overall work for

supervision and administration of safety of dangerous chemicals of the people’s

governments of municipalities (with districts) and the people’s governments at the

county level shall be determined by the people’s governments at all levels, and fulfill

their responsibilities in accordance with these Regulations.

(2) The public security organs shall be responsible for the public security control over

dangerous chemicals, be responsible for the issuance of hyper-toxic chemical

purchase credence and purchase licenses, be responsible for examining, approving,

and issuing road transportation passes for hyper-toxic chemicals, be responsible for

supervision over the safety of the road transportation of dangerous chemicals, and

be responsible for the supervision and examination of the aforesaid matters.

(3) The administrative departments in charge of quality control shall be responsible for

the issuance of the manufacture licenses for dangerous chemicals and their packing

materials as well as containers, be responsible for the supervision over the quality of

packing materials and containers of dangerous chemicals, and be responsible for the

supervision and examination of the aforesaid matters.

(4) The administrative departments in charge of environmental protection shall be

responsible for the supervision and administration of the disposal of wasted

dangerous chemicals, be responsible for the investigation of serious dangerous

chemical pollution accidents and the ecological damage incidents, be responsible for

the emergency monitoring of the sites of toxic chemical accidents and registration of

the imported dangerous chemicals, and be responsible for the supervision and

examination of the aforesaid matters.

(5) The administrative departments in charge of railways and civil aviation shall be

responsible for the railway and air transportation of dangerous chemicals, and the

safety control, supervision, and examination of railway and air transportation units for

dangerous chemicals and their means of transport. The administrative departments

in charge of communications shall be responsible for the safety control of the

highway and waterway transportation units for dangerous chemicals and their means

of transport, and the supervision over safety in the waterway transportation of

dangerous chemicals, be responsible for determining the professional levels of

highway and waterway transportation units for dangerous chemicals, drivers,

shipmen, loading and unloading personnel, and transport escorts, and be

responsible for the supervision and examination of the aforesaid matters.

(6) The administrative departments in charge of health shall be responsible for the

authentication of toxicity of dangerous chemicals, and the medical rescue of the

personnel who die or are injured due to accidents of dangerous chemicals.

(7) The administrations for industry and commerce shall, in accordance with the

approval or licenses of the relevant departments, issue the business licenses for

units that manufacture, deal in, store, or transport dangerous chemicals, and

supervise and administer the business operations in the dangerous chemical market.

(8) The administrative departments in charge of post shall be responsible for the

supervision and examination of dangerous chemicals sent by post.

Article 6 The relevant departments in charge of supervision and administration of units of dangerous chemicals in accordance with these Regulations may exercise the following powers in the course of supervision and examination according to law:

(1) To enter into the operating sites of dangerous chemicals to make the spot

examination, to transfer the relevant materials, and learn the relevant information

form the personnel concerned, and to table the proposals for units of dangerous

chemicals to make rectification and improvement;

(2) To order the parties concerned to eliminate the hidden risks of accidents of

dangerous chemicals forthwith or within a specified time limit when such risks are

discovered;

(3) To order the parties concerned to cease forthwith the use of facilities, equipment,

apparatus, and means of transport that fails to meet the relevant laws, regulations,

rules, and national standards based on evidence; and

(4) To make corrections on the spot, or to order the parties concerned to make

corrections when finding the illegal acts.

Units of dangerous chemicals shall be subject to the supervision and examination conducted by the relevant departments according to law without refusal or hindrance.

When performing their duties of supervision and examination, the personnel assigned by the relevant departments shall produce their certificates.

Chapter II Manufacture, Storage, and Use of Dangerous Chemicals

Article 7 The State carries out the unified planning, rational arrangement, and strict control over the manufacture and storage of dangerous chemicals, and implements the system to examine and approve the manufacture and storage of dangerous chemicals. Without examination and approval of the State, any units and individuals shall not manufacture or storage dangerous chemicals.

The people’s governments at the municipality level (with districts established within the municipality ) shall, according to the local actual demand for the economic development, allocate the appropriate areas to be specialized for the manufacture and storage of dangerous chemicals in accordance with the principle of ensuring safety when making the overall planning.

Article 8 An enterprise for manufacture or storage of dangerous chemicals must fulfill the following qualifications:

(1) It shall have the manufacture techniques, equipment, or warehousing means and

facilities meeting the national standards;

(2) The distance of protection around factories and warehouses shall meet the national

standards or the relevant provisions of the State;

(3) It shall have the management and technical personnel satisfying the demand for

manufacture or storage;

(4) It shall have healthy safety control system; and

(5) It shall have full qualifications as required by laws, regulations, and national

standards..

Article 9 In order to establish an enterprise for the manufacture or storage of hyper-toxic chemicals, and an enterprise for the manufacture or storage of other dangerous chemicals, the applications shall be filed to the administrative department in charge of economy and trade of the relevant province, autonomous region, or municipality directly under the Central People’s Government and the administrative department in charge of the overall work of supervision and administration of safety in dangerous chemicals of the people’s government at the municipality level (with districts) respectively, and submit the following documents:

(1) The feasibility research report;

(2) Indicators of physical chemical properties such as ignition point, spontaneous

combustion point, flash point, limits of explosion, toxicity, etc. of raw materials,

intermediary products, final products, or stored dangerous chemicals;

(3) Technical requirements on the packing, storage, and transportation;

(4) A safety evaluation report;

(5) Measures emergency rescue; and

(6) The supporting documents fulfilling conditions of Article 8 herein.

The administrative departments in charge of economy and trade of the people’s governments of provinces, autonomous regions, and municipalities directly under the Central People’s Government, or the administrative departments in charge of the overall work of supervision and administration of safety of dangerous chemicals of the people’s governments at the municipality level (with districts) shall organize the relevant experts to examine the applications received and the documents submitted, and shall report the examination opinions of these experts to the people’s governments at the same levels to make decisions of approval or disapproval. According the decisions of the people’s governments, the administrative departments in charge of economy and trade of the people’s governments of provinces, autonomous regions, and municipalities directly under the Central People’s Government, or the administrative departments in charge of the overall work of supervision and administration of safety of dangerous chemicals of the people’s governments at the municipality level (with districts) shall issue the documents of approval to the approved applicant; otherwise, they shall notify the disapproved applicants in writing.

The approved applicants shall go through the registration formalities with the administrations for industry and commerce depending on the documents of approval.

Article 10 Except the fueling stations for means of transport, such quantity of the installations manufacturing and storing dangerous chemicals constituting the serious hazard sources and the distance from the following places and areas must satisfy the national standards or the relevant provisions of the State:

(1) Resident estates, commercial centers, parks, and other densely inhabited districts;

(2) Schools, hospitals, cinemas, stadiums, gymnasiums, and other public facilities;

(3) Water supply sources, water plants, and water source protection zones;

(4) Stations, docks (excluding those specialized for loading and unloading of dangerous

chemicals upon approval according to the relevant provisions of the State), airports,

highways, railways, waterway main lines, wind booths, entrance, and exit of

underground railways;

(5) The basic farmland protection zones, animal husbandry zones, fishing waters, and

bases to produce seeds, breeders, and offspring of aquatic products;

(6) Rivers, lakes, places of historical interest and scenic spots, and natural protection

zones;

(7) Prohibited military zones and military control zones; and

(8) Other areas to be protected by laws and administrative regulations.

In case that the quantity of installations manufacturing dangerous chemicals that have been built, and the storage facilities that constitute the serious hazard sources does not fulfill the provisions of the preceding Paragraph, the administrative departments in charge of the overall work for the supervision and administration of safety of dangerous chemicals of the people’s governments at the municipality level (with districts established within the municipality ) shall supervise the parties concerned to make rectification and improvement within the specified time limit. The change of the line of production, the stoppage of

production, the move, or shutdown shall be reported to the people’s governments at the same levels for approval, and carry out such activities upon approval.

“Serious hazard sources” as referred to herein means cells (including places and installations) in which the dangerous chemicals are manufactured, transported, used, or stored, or the wasted chemicals are disposed of , and the quantity of dangerous chemicals is equal to or exceeds the threshold quantity.

Article 11 The reconstruction or expansion of an enterprise for manufacture or storage of dangerous chemicals must be examined and approved in accordance with the provisions of Article 9 herein.

Article 12 An enterprise to manufacture dangerous chemicals that is established according to law must apply to the administrative department in charge of quality control of the State Council for drawing the license for manufacturing dangerous chemicals; any enterprise that fails to obtain such license shall not commence the manufacture of dangerous chemicals.

The administrative department in charge of quality control of the State Council shall notify the administrative department in charge of comprehensive management of economy and trade, the administrative department in charge of environmental protection, and the public security organ of the State Council of the situation about the issuance of licenses for manufacturing dangerous chemicals.

Article 13 Any units and individuals shall not manufacture, deal in, or use dangerous chemicals that are prohibited by the State’s public proclamation.

Hyper-toxic chemicals shall be prohibited from manufacturing raticides and other chemical products and chemicals for the daily use.

Article 14 Whoever manufactures dangerous chemicals shall attach the technical specifications for the safety of chemicals in full accord with dangerous chemicals in the packing materials of dangerous chemicals, and affix or post the safety signs for chemicals in full accord with dangerous chemicals in the packing materials on the external packaging materials.

When finding that dangerous chemicals manufactured have the new hazard characteristics, the manufacturing enterprises of dangerous chemicals shall make the public announcements forthwith, and modify the technical specifications for safety and the safety signs in time.

Article 15 The production conductions of units engaging in the manufacture of dangerous chemicals must fulfill the national standards and the relevant provisions of the State, and these units shall obtain the corresponding licenses in accordance with the relevant laws and regulations of the State, must establish and strengthen the regulations and rules on the safety control over the use of dangerous chemicals, and guarantee the safe use and control over dangerous chemicals.

Article 16 Whoever manufactures, stores, or makes use of dangerous chemicals shall,

according to the varieties and characteristics of dangerous chemicals, set up the corresponding safety facilities and equipment for monitoring, ventilation, burning resistance, tempering, fireproofing, fire control, explosion protection, pressure relief, antitoxin, disinfections, neutralization, moisture prevention, lightning protection, static electricity resistance, antisepsis, seep-proofing, reclamation dam protection, or isolated operation in the workshops and operating sites, maintain and protect them in accordance with the national standards and the relevant provisions of the State, and guarantee that they satisfy the requirements on safe operation.

Article 17 A unit that manufactures, stores, or makes use of hyper-toxic chemicals shall conduct safety evaluation of its own manufacturing or storage installations once a year. A unit that manufactures, stores, or makes use of other dangerous chemicals shall conduct the safety evaluation of its own manufacturing or storage installations once two years.

The safety evaluation report shall cover a proposal to make rectification and improvement against the safety problems in manufacturing or storage installations. The manufacturing or storage installations threatened by the real hazards discovered in the course of the safety evaluation shall be fall into disuse forthwith, replaced or repaired, and the corresponding safety measures shall be adopted.

The safety evaluation report shall be submitted to the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals of the people’s government at the municipality level (with districts) for record.audition

Article 18 Units that manufacture, store, and use dangerous chemicals shall set up the communication and alarming installations in the manufacturing, storage, and use places, and guarantee their normal applicable conditions under any circumstances.

Article 19 A unit that manufactures, stores, or makes use of hyper-toxic chemicals shall record the output, flow direction, storage quantity, and purposes of such chemicals according to the facts, and adopt the necessary security measures to prevent such chemicals from being stolen, lost, or sold by error, or misused; when finding that hyper-toxic chemicals are stolen, lost, sold by error, or misused, it must make a report to the local public security organ forthwith.

Article 20 The packaging of dangerous chemicals must accord with laws, regulations, and rules of the State, and satisfy the requirements of the national standards.

The material, models, specifications, methods, and unit quantity (weight) of the packing of dangerous chemicals shall be adapted to the nature and purposes of the packaged dangerous chemicals, and be convenient for loading, unloading, transportation, and storage.

Article 21 The packing materials and containers of dangerous chemicals shall not be used unless they are manufactured by the professional manufacturing enterprises passing the examination of the administrative departments in charge of economy and trade of the people’s governments at the provincial level, and pass the professional test and inspection institutions admitted by the administrative department in charge of quality control of the State Council.

The packing materials and containers for repeated use shall be inspected before being

used, and the corresponding records shall be made; the inspection records shall be kept for two years at least.

The administrative departments in charge of quality control shall inspect the quality of the packing materials and containers at regular or irregular intervals.

Article 22 Dangerous chemicals must be stored within the specialized warehouses, places, or storage rooms (hereinafter referred to as the “specialized warehouses”), and be managed by the specially assigned personnel. The storage means, methods, and the quantity stored must meet the national standards.

The dangerous chemicals’ entry into, and exit from warehouses must be inspected and registered. The stock dangerous chemicals shall be inspected at regular intervals.

Hyper-toxic chemicals and other dangerous chemicals that constitute serious hazard sources in quantity must be stored within the specialized warehouses separately, and be subject to the system of double-person receiving and dispatching and double-person safekeeping. A storage unit shall report the quantity, places, and management personnel of stored hyper-toxic chemicals and other dangerous chemicals that constitute serious hazard sources to the local public security organ and the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals for records.

Article 23 The specialized warehouses for dangerous chemicals shall satisfy requirements of the national standards on the safety and fire control, and prominent signs shall be set up for these warehouses. The storage equipment and safety facilities for these warehouses shall be checked at regular intervals.

Article 24 The disposal of wasted dangerous chemicals shall be based on the Law on Prevention and Control over the Environmental Pollution Caused by Solid Wastes and the relevant provisions of the State.

Article 25 When units that manufacture, store, or use dangerous chemicals halt production, change the line of production, shut down, or dissolved, they shall adopt the effective measures to dispose the manufacturing or storage equipment for dangerous chemicals, inventory products, and manufacturing materials, and shall not leave over hidden risk of accident. The disposal proposal shall be submitted to the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals of the local people’s government at the municipality level (with districts established within the municipality), and the administrative department in charger of environmental protection and the public security organ at the same level for record. The administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals shall supervise and examine the disposal.

Article 26 Dangerous chemicals turned over by the public shall be taken over by the public security organs. Dangerous chemicals taken over by the public security organs and those captured by other relevant departments shall be handed over to the professional units

admitted by the administrative departments in charge of environmental protection for disposal.

Chapter III Operation of Dangerous Chemicals

Article 27 The State carries out the licensing system for dealing in dangerous chemicals. Without being licensed, any units and individuals shall deal in dangerous chemicals.

Article 28 An enterprise that deals in dangerous chemicals must fulfill the following qualifications:

(1) Its business premises and storage facilities shall conform to the national standards;

(2) The executive staff and the business personnel shall received the professional

training and be qualified for holding their posts;

(3) It shall have a healthy safety control system; and

(4) It shall full qualifications as required by laws, regulations, and national standards.

Article 29 In order to deal in hyper-toxic chemicals and other dangerous chemicals, the applications shall be filed to the administrative departments in charge of economy and trade of the relevant provinces, autonomous regions, or municipalities directly under the Central People’s Government or the administrative departments in charge of the overall work of supervision and administration of safety in dangerous chemicals of the people’s governments at the municipality level (with districts) respectively, and submit the supporting documents for qualifications as specified in Article 28 herein. The administrative departments in charge of economy and trade of the people’s governments of provinces, autonomous regions, and municipalities directly under the Central People’s Government, or the administrative departments in charge of the overall work of supervision and administration of safety of dangerous chemicals of the people’s governments at the municipality level (with districts) shall, upon the receipt of applications, examine the supporting documents submitted by the applicants and their business premises in accordance with the provisions herein. Upon examination, they shall issue the licenses for dealing in dangerous chemicals to the qualified applicants, notify the public security organs and the administrative departments in charge of environmental protection at the same levels of the corresponding information, and inform the unqualified applicants in writing of the corresponding reasons.

The approved applicants shall go through the registration formalities with the administrations for industry and commerce depending on the licenses for dealing in dangerous chemicals.

Article 30 Enterprises that deal in dangerous chemicals shall not commit the following acts:

(1) To purchase dangerous chemicals from enterprises that fail to obtain the licenses for

manufacturing such chemicals or the licenses for dealing in such chemicals;

(2) To deal in hyper-toxic chemicals that have been prohibited from being manufactured,

raticides manufactured by hyper-toxic chemicals, and other chemical products and

chemicals for daily use; or

(3) To sell dangerous chemicals without technical specifications or signs for safety of

chemicals.

Article 31 Enterprises that manufacture dangerous chemicals shall not sell such chemicals to units or individuals who fail to obtain the licenses for dealing in dangerous chemicals.

Article 32 Enterprises that deal in dangerous chemicals, for the purpose to store such chemicals, shall abide by the relevant provisions in Chapter II herein. Shops of dangerous chemicals shall have no option but to store fractional-package dangerous chemicals for civil use, and the total quantity of such chemicals in a shop shall not exceed the quota provided by the State.

Article 33 Enterprises that deal in hyper-toxic chemicals, when selling such chemicals, shall record names and addresses of purchase units, names and identity card numbers of purchasing personnel, as well as item names, quantity, and purposes of purchased hyper-toxic chemicals. Such records shall be kept for one year at least.

Enterprises that deal in hyper-toxic chemicals shall check the sales of such chemicals by the day; when discovering that such chemicals are stolen, lost, or sold by error, they must make reports to the local public security organs forthwith.

Article 34 The purchase of hyper-toxic chemicals shall be subject to the following provisions:

(1) The manufacturing, scientific research, and medical units that make use of

hyper-toxic chemicals frequently shall apply to the public security organs of the

people’s governments at the municipality level (with districts established within the

municipality) for drawing the purchase credence, and purchase such chemicals

depending on the purchase credence;

(2) Units that need to purchase hyper-toxic chemicals temporarily shall apply to the

public security organs of the people’s governments at the municipality level (with

districts) for drawing the purchase credence depending on the certification (item

names, quantity, and purposes indicated), and purchase such chemicals depending

on the purchase credence; and

(3) Individuals shall not purchase hyper-toxic chemicals other than pesticides, raticides,

and drugs to kill parasites.

Enterprises that manufacture or deal in hyper-toxic chemicals shall not sell such chemicals to units without purchase credence or purchase licenses or individuals. The credence or licenses for purchase of hyper-toxic chemicals shall not be forged, mutilated, purchased, sold, lent, or transferred by other means, and the invalidated credence or licenses for purchase of such chemicals shall not be used.

The public security organ of the State Council shall formulate the formats of such credence and licenses, and the specific measures on drawing them.

Chapter IV Transportation of Dangerous Chemicals

Article 35 The State carries out the professional level recognizing system for the transportation of dangerous chemicals; whoever fails to pass the professional level recognition shall not transport such chemicals.

The qualifications that must be fulfilled by enterprises that transport such chemicals shall be formulated by the administrative department in charge of communications of the State Council.

Article 36 Trough containers and other containers used for transporting dangerous chemicals shall not be used unless they are manufactured by the appointed professional manufacturing enterprises, and pass the test as well as inspection in accordance with the provisions of Article 21 herein.

The administrative departments in charge of quality control shall inspect the quality of trough containers and other containers manufactured by the appointed professional manufacturing enterprises as specified in the preceding Paragraph in regular or irregular intervals.

Article 37 Enterprises that transport dangerous chemicals shall train their drivers, shipmen, loading and unloading management personnel, and transport escorts for the relevant knowledge about safety, and these personnel shall not hold their posts unless they have mastered the knowledge about safety in transportation of dangerous chemicals, passed the examination organized by the administrative departments in charge of communications of the people’s governments at the municipality level (with districts) (or passed the examination organized by the administrative departments in charge of maritime affairs, for shipmen), and obtained the post-holding qualification certificates. The loading and unloading of dangerous chemicals must be conducted under the spot command of the loading and unloading management personnel.

Drivers, shipment, loading and unloading personnel, and transport escorts for the transportation of dangerous chemicals must learn the properties and hazard characteristics of such chemicals, characteristics for the use of packing containers, and emergency measures in case of accidents. For the transportation of dangerous chemicals, the necessary emergency apparatus and protective appliances must be equipped.

Article 38 For the transportation of dangerous chemicals through highways, consignors shall have no option but to entrust professional transportation enterprises to transport such chemicals to transport such chemicals.

Article 39 For the transportation of hyper-toxic chemicals through highways, consignors shall apply to the public security organs of the people’s governments at the county level of places of destination for the highway transportation pass for hyper-toxic chemicals.

In order to apply for the highway transportation pass for hyper-toxic chemicals, an consignor shall submit materials about the item names and quality of dangerous chemicals involved, the places of departure and destination, transportation route, transportation unit,

drivers, transport escorts, professional levels of operating unit and purchase unit to the public security organ.

The public security organ of the State Council shall formulate the format of the highway transportation pass for hyper-toxic chemicals, and the specific measures on drawing it.

Article 40 The transportation of hyper-toxic chemicals and other dangerous chemicals whose transportation has been prohibited by the administrative department in charge of communications of the State Council shall be prohibited by making use of shipping channels such as inland rivers and other enclosed waters.

For the transportation of dangerous chemicals other than those as specified in the preceding Paragraph through shipping channels such as inland rivers and other enclosed waters, consignors shall have on option but to entrust the water transportation enterprises with the corresponding professional levels to transport such chemicals, go through formalities in accordance with the provisions of the administrative department in charge of communications of the State Council, and be subject to the supervision and administration of the relevant administrative departments in charge of communications (port administrations, administrative departments in charge of maritime affairs, hereinafter inclusive).

Ships used to transport dangerous chemicals and containers carried by them shall not be put into use unless they are manufactured in accordance with the standards of the State on the inspection of ships, and pass the inspection organized by the ship inspection institutions admitted by the administrative departments in charge of maritime affairs.

Article 41 Consigners, when consigning dangerous chemicals, shall state the item names, quantity, hazards, emergency measures, etc. of such chemicals to the carriers.

When the depressors or stabilizers need to be added for the transportation of dangerous chemicals, consignors shall add them upon the consignment, and inform the carriers.

Consignors shall neither carry secretly dangerous chemicals in consigned common goods, nor withhold information about dangerous chemicals, nor report dangerous chemicals as common goods.

Article 42 The necessary safety protection measures shall be adopted for the transportation, loading, and unloading of dangerous chemicals in accordance with the relevant laws, regulations, rules, and national standards, and in the light of hazard characteristics of such chemicals.

Trough containers and other containers used to transport dangerous chemicals must be sealed strictly, bear the internal and external pressure produced under the normal transport conditions, and guarantee that dangerous chemicals do not leak or sprinkle in case of changes of temperature, moisture or pressure in the course of transportation.

Article 43 For the transportation of dangerous chemicals through highways, the transport escorts must be assigned, and such chemicals shall be under the supervision of such escorts at any moment; the transport vehicles shall neither overload such chemicals, nor enter into areas with no thoroughfare for such vehicles. If it is necessary for such vehicles to enter into such areas with on thoroughfare, the reports shall be made to the local public security organs

in advance; the public security organs shall appoint the driving time and routes, and the transport vehicles must be subject to such time and routes prescribed by the public security organs.

Areas with no thoroughfare for transport vehicles for dangerous chemicals shall be delimited by the public security organs of the people’s governments at the municipality level (with districts), and the prominent signs shall be set up.

In case of parking transport vehicles for dangerous chemicals for accommodation on the way or abnormal transportation, reports shall be made to the local public security organs.

Article 44 When hyper-toxic chemicals are stolen, are lost, are drained, or leak on the way of highway transportation, the carriers and transport escorts must make reports to the local public security organs forthwith, and adopt all possible caution measures. The public security organs, upon the receipt of reports, shall notify other departments concerned of the relevant situations forthwith, and these departments shall adopt the necessary safety measures.

Article 45 Any units and individuals shall neither send dangerous chemicals by post, nor carry secretly such chemicals in mails, nor withhold information about such chemicals, nor report such chemicals as common goods for post.

Article 46 The transportation of dangerous chemicals through railways or by air shall be based on the relevant provisions of the administrative departments in charge of railways and civil aviation of the State Council.

Chapter V Registration of Dangerous Chemicals and Emergency Rescue

Article 47 The State carries out the system of registration of dangerous chemicals, and provides the technical and information support for the safety control over dangerous chemicals, accident prevention, and emergency rescue.

Article 48 Enterprises that manufacture or store dangerous chemicals, and units that use hyper-toxic chemicals and other dangerous chemicals that constitute serious hazard sources in quantity shall register dangerous chemicals with the organ responsible for registration of dangerous chemicals of the administrative department in charge of comprehensive management of economy and trade of the State Council. The specific measures for registration of dangerous chemicals shall be formulated by the administrative department in charge of comprehensive management of economy and trade of the State Council.

The organ responsible for registration of dangerous chemicals shall provide the data about registration of such chemicals to the administrative departments in charge of environmental protection, public security, quality control, health, etc.

Article 49 The administrative departments in charge of the overall work of supervision and administration of safety of dangerous chemicals of the local people’s governments at or above the county level shall jointly with other departments concerned at the same levels

formulate the emergency rescue pre-proposals, and implement them upon approval of the people’s governments at the same levels.

Article 50 Units of dangerous chemicals shall formulate their own emergency rescue pre-proposals, assign the emergency rescue personnel, be equipped with necessary emergency apparatus and equipment, and organize the drilling at regular intervals.

The pre-proposal for emergency rescue in case of dangerous chemical accidents shall be submitted to the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals of the people’s government at the municipality level (with districts) for record.

Article 51 In case of a dangerous chemical accident, the person chiefly in charge of the unit involved shall, in accordance with the emergency rescue pre-proposal formulated by this unit, organize the rescue forthwith, and make a report to the local administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals, the pubic security organ, the administrative department in charge of environmental protection, and the administrative department in charge of quality control respectively forthwith.

Article 52 In case of a dangerous chemical accident, the local people’s government concerned shall accomplish the command and leadership. The administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals, the pubic security organ, and the administrative department in charge of environmental protection, health, etc. shall, in accordance with the local emergency rescue contingent proposals, organize the rescue without any delay or prevarication. The local people’s government and its departments concerned shall, in accordance with the following provisions, adopt the necessary measures to reduce the loss caused by the accident, and to prevent the accident from extending:

(1) They shall organize the rescue of the victims, organize the evacuation, or adopt other

protective measures to protect other personnel in the hazard areas forthwith;

(2) They shall promptly control the hazard sources, inspect and monitor hazards caused

by dangerous chemicals, and determine the accident’s hazard areas, properties of

dangerous chemicals, and extent of hazard;

(3) They shall promptly adopt measures of enclosing, isolation, disinfections, etc. against

the actual hazards caused to the human body, animals, plants, soil, water sources,

and air caused by the accident and the contingent hazards; and

(4) They shall monitor and dispose of hazards caused by the accident until the national

environmental protection standards are met.

Article 53 Enterprises that manufacture dangerous chemicals must provide the technical guidance and necessary assistance for the emergency rescue against accidents caused by dangerous chemicals.

Article 54 The administrative departments in charge of environmental protection shall

announce in a unified way the information about the environmental protection caused by dangerous chemical accidents.

Chapter VI Legal Liability

Article 55 The staff of the relevant departments in charge of supervision and administration of manufacture, operation, storage, transportation, and use of dangerous chemicals, and disposal of wasted dangerous chemicals, if committing one of the following acts, shall be imposed such administrative sanction as degrading or dismissal from their posts according to law; whoever commits a crime shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of accepting bribes, the crime of abusing powers, the crime of neglect of duty, or other crimes:

(1) Receiving property or other benefits from others by taking advantages of offices,

approving or licensing matters concerning manufacture, operation, storage,

transportation, and use of dangerous chemicals, and disposal of wasted dangerous

chemicals that do not fulfill conditions as provided herein;

(2) Failing to outlaw or handle according to law units and individuals that are discovered

to engage in the relevant activities without being approved or licensed according to

law, or upon the receipt of reports; or

(3) Failing to fulfill the supervisory and administrative responsibilities for units and

individuals that are approved or licensed according to law, failing to revoke the

original approval or license of units and individuals who do not satisfy the conditions

as specified herein any longer, or failing to investigate and handle acts in violation of

these Regulations.

Article 56 In case of an accident caused by dangerous chemicals, if the relevant departments concerned fail to fulfill their responsibilities to organize the rescue, or to adopt the necessary measures to reduce the loss hereof, and to prevent the accident from extending, delay to deal with the accident, or prevaricate, the persons chiefly in charge with responsibilities and other directly responsible personnel shall be imposed administrative sanction of degrading or dismissal from their posts; whoever commits a crime shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of abusing powers, the crime of neglect of duty, or other crimes.

Article 57 Whoever, in violation of these Regulations, commits one of the following acts, shall be shut down, ordered to stop production or business for rectification, ordered to destroy dangerous chemicals whose manufacture, operation, and use are prohibited by the State’s public proclamation, raticides manufactured by hyper-toxic chemicals, and chemical products as well chemicals for daily use with innocuity by the administration for industry and commerce, the administrative department in charge of quality control, and the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals respectively. The illegal gains, if any, shall be confiscated. If the illegal gains are not less than RMB 100,000, the offender shall be imposed a fine of not less than the amount of illegal gains but not more than five times hereof. If there is no gain from illegal conduct or the

illegal gains are not more than RMB 100,000, the offender shall be imposed a fine of not less than RMB 50,000 but not more than RMB 500,000. Where the Criminal Law is violated, the person chiefly in charge with liability and other directly responsible personnel shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of causing an accident in the control of dangerous articles, the crime of illegal operating, or other crimes:

(1) Engaging in the manufacture or storage of dangerous chemicals without approval or

registration with the administration for industry and commerce;

(2) Starting the manufacture of dangerous chemicals without the license for

manufacturing dangerous chemicals;

(3) Reconstruction or expansion of the enterprise that manufactures or stores

dangerous chemicals without examination and approval;

(4) Engaging in operation of dangerous chemicals without the license for dealing in

dangerous chemicals or registration with the administration for industry and

commerce; or

(5) Manufacturing, dealing in, or using hyper-toxic chemicals that have been prohibited,

raticides manufactured by hyper-toxic chemicals, and other chemicals products and

chemicals for daily use.

Article 58 A unit of dangerous chemicals that, in violation of these Regulations, fails to, according to the varieties and characteristics of dangerous chemicals, set up the corresponding safety facilities and equipment for monitoring, ventilation, burning resistance, tempering, fireproofing, fire control, explosion protection, pressure relief, antitoxin, disinfections, neutralization, moisture prevention, lightning protection, static electricity resistance, antisepsis, seep-proofing, reclamation dam protection, or isolated operation in the workshops and operating sites shall be ordered to make corrections within a specified time limit, and be imposed a fine of not less than RMB 20,000 but not more than RMB 100,000 by the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals, and the public security organ ex officio. If it commits a crime, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of causing an accident in the control over dangerous articles, the crime of negligently causing a serious accident, or other crimes.

Article 59 Whoever, in violation of these Regulations, commits one of the following acts shall be ordered to make corrections forthwith or within a specified time limit, and be imposed a fine of not less than RMB 20,000 but not more than RMB 200,000 by the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals, the administrative department in charge of quality control, or the administrative department in charge of communications ex officio. If it fails to make corrections with the specified time limit, it shall be ordered to stop business for rectification. Where the Criminal Law is violated, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of causing an accident in the control over

dangerous articles, the crime of manufacturing or selling imitative and inferior commodities, or other crimes:

(1) Manufacturing packing materials or containers for dangerous chemicals without

authorization when it is not an appointed manufacturing enterprise;

(2) Using ships used to transport dangerous chemicals and containers carried by them

that are not manufactured in accordance with the standards of the State on the

inspection of ships, and fail to pass the inspection;

(3) Using material, models, specifications, methods, and unit quantity (weight) of the

packaging of dangerous chemicals not adapted to the properties and purposes of the

packaged dangerous chemicals;

(4) Failing to inspect the packing materials and containers for dangerous chemicals that

are used repeatedly before the use; or

(5) Using packing materials and containers that are not manufactured by appointed

manufacturing enterprises, or tested, or fail to pass the inspection and testing on

packing and transportation.

Article 60 A unit of dangerous chemicals that, in violation of these Regulations, commits one of the following acts shall be ordered to make corrections forthwith or within a specified time limit, and be imposed a fine of not less than RMB 10,000 but not more than RMB 5 by the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals. If it fails to make corrections within the specified time limit, it shall be ordered to stop production for rectification:

(1) Where an enterprise that manufactures dangerous chemicals fails to attach the

technical specifications for the safety of chemicals in full accord with dangerous

chemicals in the packing materials of dangerous chemicals, or fails to affix or post

the safety signs for chemicals in full accord with dangerous chemicals in the packing

materials on the external packaging materials;

(2) Where an enterprise that manufactures dangerous chemicals fails to make a public

announcement forthwith, or revise its technical specifications and signs for safety of

chemicals when finding that dangerous chemicals have new hazard characteristics;

or

(3) Where an enterprise that deals in dangerous chemicals without technical

specifications or signs for safety of chemicals.

Article 61 A unit of dangerous chemicals that, in violation of these Regulations, commits one of the following acts shall be ordered to make corrections forthwith or within a specified time limit, and be imposed a fine of not less than RMB 10,000 but not more than RMB 50,000 by the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals or the public security organ ex officio. If it fails to make corrections with the specified time limit, the original license-issuing authorities shall revoke its license for manufacturing dangerous chemicals, or the license for dealing in dangerous chemicals, and the business license. Where it violates the Criminal Law, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of

causing an accident in the control over dangerous articles, crime of negligently causing a serious accident, or other crimes:

(1) Where it fails to make safety evaluation for its manufacturing or storage installations

at regular intervals, and to make it to the administrative department in charge of the

overall work for the supervision and administration of safety of dangerous chemicals

of the local people’s government at the municipality level (with districts established

within the municipality) for records, or it fails to forthwith cease the use of, replace, or

repair manufacturing or storage installations threatened by actual hazards

discovered in the safety evaluation, and to adopt the corresponding safety measures;

(2) Where it fails to set up communication or alarming installations in places where

dangerous chemicals are manufactured, stored, and used, and to keep them in the

normal applicable conditions;

(3) Where it fails to store dangerous chemicals within the specialized warehouses, or

fails to assign the specialized personnel to manage them;

(4) Where it fails to check and register the dangerous chemicals’ entry into, and exit from

warehouses, or fails to inspect such chemicals after their entry into warehouses at

regular intervals;

(5) Where it uses specialized warehouses for dangerous chemicals that fail to satisfy the

requirements of the national standards on the safety and fire control, and fails to set

up the prominent sign for these warehouses, or fails to inspect the warehousing

equipment and safety facilities of such specialized warehouses at regular intervals;

(6) Where a distributing shop of dangerous chemicals stores fractional-package

dangerous chemicals not for civil use, or the total quantity of such chemicals in the

shop exceeds the quota provided by the State;

(7) Where hyper-toxic chemicals, and other dangerous chemicals that constitute serious

hazard sources in quantity are not stored in the specialized warehouses separately,

or are not subject to the double-person receiving, dispatching, and safekeeping, or

the quantity, places, and management personnel of stored hyper-toxic chemicals and

other dangerous chemicals that constitute serious hazard sources are not reported to

the local public security organ and the administrative department in charge of the

overall work for the supervision and administration of safety of dangerous chemicals

for record;

(8) Where a unit that manufactures dangerous chemicals fails to record the output, flow

direction, storage quantity, and purposes of such chemicals according to the facts,

fails to adopt the necessary security measures to prevent such chemicals from being

stolen, lost, or sold by error, or misused, or fails to make a report to the local public

security organ forthwith when hyper-toxic chemicals are stolen, lost, sold by error, or

misused; or

(9) Where an enterprise that deals in dangerous chemicals fails to record names and

addresses of purchase units, names and identity card numbers of purchasing

personnel, as well as item names, quantity, and purposes of purchased hyper-toxic

chemicals, or fails to check the sales of hyper-toxic chemicals by the day, or fails to

make reports forthwith to the local public security organ when finding that dangerous

chemicals are stolen, lost, or sold by error.

Article 62 A unit of dangerous chemicals that, in violation of these Regulations, fails to adopt the effective measures to dispose of the equipment to manufacture or store dangerous chemicals, inventory products, and raw materials for manufacturing when it changes the line of production, stops production or business, or is dissolved shall be ordered to make corrections forthwith or within a specified time limit, and be imposed a fine of not less than RMB 20,000 but not more than RMB 10,000 by the administrative department in charge of the overall work for the supervision and administration of safety of dangerous chemicals or the public security organ ex officio. Where it violates the Criminal Law, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of causing an accident due to environmental protection, the crime of causing an accident in the control over dangerous articles, or other crimes.

Article 63 Whoever, in violation of these Regulations, commits one of the following acts, shall be ordered to make corrections by the administration for industry and commerce. The illegal gains, if any, shall be confiscated. If the illegal gains are not less than RMB 50,000, the offender shall be imposed a fine of not less than the amount of illegal gains but not more than five times hereof. If there is no gain from illegal conduct or the illegal gains are not more than RMB 50,000, the offender shall be imposed a fine of not less than RMB 20,000 but not more than RMB 200,000. Where the Criminal Law is violated, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of causing an accident in the control of dangerous articles, the crime of illegal operating, or other crimes:

(1) Where an enterprise that manufactures dangerous chemicals purchases dangerous

chemicals from enterprises that fail to obtain the licenses for manufacturing such

chemicals or the licenses for dealing in such chemicals;

(2) Where an enterprise that manufactures dangerous chemicals sells such chemicals to

units or individuals who fail to obtain the licenses for dealing in dangerous chemicals;

or

(3) Where an enterprise that deals in hyper-toxic chemicals sell such chemicals to units

without purchase credence or purchase licenses or individuals.

Article 64 Whoever, in violation of these Regulations, forges, mutilates, trades in, lends, or transfers by other means the purchase credence or licenses for hyper-toxic chemicals, or other relevant licenses, or uses the aforesaid licenses that are invalidated shall be ordered to make corrections, and be imposed a fine of not less than RMB 10,000 but not more than RMB 500,000 by the public security organ. Where the Criminal Law is violated, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of forging, mutilating, or trading in official documents, credentials, and seals of state organs, or other crimes.

Article 65 Whoever, in violation of these Regulations, fails to obtain the professional level

for an enterprise that transports dangerous chemicals and engages in the highway or waterway transportation of dangerous chemicals without authorization shall have its illegal gains, if any, confiscated by the administrative department in charge of communications. If the illegal gains are not less than RMB 50,000, the offender shall be imposed a fine of not less than the amount of illegal gains but not more than five times hereof. If there is no gains from illegal conduct or the illegal gains are not more than RMB 50,000, the offender shall be imposed a fine of not less than RMB 20,000 but not more than RMB 200,000. Where the Criminal Law is violated, the person chiefly in charge with liability and other directly responsible personnel hereof shall be prosecuted for criminal liability according to the provisions of the Criminal Law on the crime of causing an accident in the control of dangerous articles, or any other crime.

Article 66 Whoever, in violation of these Regulations, commits one of the following acts shall be imposed a fine of not less than RMB 20,000 but not more than RMB 100,000 by the administrative department in charge of communications; where the offender violates the Criminal Law, it shall be prosecuted for criminal liability in accordance with the provisions of the Criminal Law on the crime of causing an accident in the control over dangerous articles, or other crimes:

(1) Where any of drivers, shipmen, loading and unloading management personnel, and

transport escorts for the highway or waterway transportation of dangerous chemicals

fails to pass the examination, but obtain the post-holding qualification certificate;

(2) Where hyper-toxic chemicals and other dangerous chemicals whose transportation

has been prohibited are transported with the use of shipping channels such as inland

rivers and other enclosed waters;

(3) Where a consignor fails to go through waterway transportation formalities with the

administrative department in charge of communications according to the relevant

provisions, but transports without authorization hyper-toxic chemicals and dangerous

chemicals other than those prohibited from being transported by the State by water;

(4) Where a consigner, when consigning dangerous chemicals, fails to state the item

names, quantity, hazards, emergency measures, etc. of such chemicals to the carrier, or fails to add depressors or stabilizers that need to be added upon the consignment;

or

(5) Where the transportation, loading, and unloading of dangerous chemicals do not

accord with the relevant laws, regulations, rules, and national standards, and the

necessary protective measures are not adopted according to characteristics of

dangerous chemicals.

Article 67 Whoever, in violation of these Regulations, commits one of the following acts shall be ordered to make corrections, and be imposed a fine of not less than RMB 20,000 but not more than RMB 100,000 by the public security organ; where the offender violates the Criminal Law, it shall be prosecuted for criminal liability in accordance with the provisions of the Criminal Law on the crime of causing an accident in the control over dangerous articles, the crime of causing an accident due to environmental pollution, or other crimes:

(1) Where a consignor fails to apply to the public security organs for the highway

危险化学品管理制度 1 目的 为使安全部在生产、生活中的油料、油漆、化学品、易燃及易爆品得到有效控制,保护人民生命和财产安全。 2 范围 适用于公司使用的易燃、易爆品、所有油料、油漆及化学品的控制和管理。 3 职责 3.1 安全部制定并组织实施本制度,负责油料、油漆及化学品的收发,建立收发台账。 3.2 综合部负责对机关办公区、生活区的易燃易爆品的控制。 3.3 安全部负责对施工现场的易燃易爆品的控制;负责对易燃、易爆品防火控制的监督检查。 4 工作程序 4.1 加强对人员的管理 4.1.1 做好全员的学习宣传教育工作。 4.1.2 严格执行防火安全制度。 4.1.3 落实防火安全责任制。 4.1.4 做好防火、灭火准备。 4.1.5 经常性的检查消防安全工作的落实情况。 4.2 加强对易燃、易爆品的管理 4.2.1 易燃、易爆品的储存 a)易燃、易爆品必须储存在专用仓库、专用场地,并设专人管理。 b)仓库内应当配备消防力量和灭火设施,严禁在仓库内吸烟和使用明火。 c)仓库要符合有关安全、防火规定,物品之间通道要保证安全距离。 d)遇火、遇潮容易燃烧、爆炸的物品,不得在露天、潮湿、漏雨和低洼容易积水的地点存放。 e)受阳光照射容易燃烧、爆炸物品应当在阴凉通风地点存放。 f)化学性质或防护、灭火方法相抵触的易燃、易爆品,不得在同一仓库内存放。 4.2.2 易燃、易爆品的运输装卸 a)在装卸过程中应轻拿轻放,防止撞击、拖拉和倾倒。 b)对碰撞、互相接触易引起燃烧、爆炸和化学性质或防护、灭火方法互相

抵触的易燃、易爆品不得违反配装限制和混合装运。 c)遇热、遇潮容易引起燃烧、爆炸的易燃、易爆物品,装运时应当采取隔热措施。 4.2.3 易燃、易爆品的使用管理 a)使用易燃、易爆品的单位要填写《易燃、易爆、油料及化学品收发台账》,对物品的名称、数量及入库日期进行登记,并及时进行清点。 b)易燃、易爆品的使用及灭火方法应按照有关操作规程或产品使用说明严格执行。 c)各种气瓶在使用时,距离明火10 m以上,氧气瓶的减压器上应有安全阀,严防沾染油脂,不得曝晒、倒置、平时与乙炔瓶工作间距不小于5m。 d)加强对火源、电源和生产中贮存、使用易燃、易爆品的场所监控。 4.3 油料、油漆及化学品管理 4.3.1 油料、油漆及化学品大部分是油液、胶质的易燃物或可燃物,既易干燥、挥发,又易受外界影响变质。因此,油料、油漆及化学品的储存及运输,必须特别注意防火、防爆、防毒、防变质。 4.3.2 明火管理及消防 贮存油料、油漆及化学品的库房必须加强消防及明火管理,必须在明显地点标明“严禁吸烟”、“严禁火种”等醒目字样或标志。库房区必须备有充足的并与各类油料、油漆及化学品相适应的消防器材。 4.3.3 库房温度和湿度 储存油料、油漆及化学品的库房必须干燥、阴凉、通风,库房尽可能保持适当的温度和湿度,库房最好面向北,防止烈日曝晒。 油料、油漆及化学品过冷过热易变质,库房温度过高,会加速油料、油漆及化学品挥发而引起容器变形,甚至爆裂渗漏,也会引起油料、油漆及化学品胶凝或粘度增浓,库房温度过低会使水溶性漆、乳胶漆结冰,影响物理化学性能,给环境带来污染。 4.3.4 严禁火种 油料、油漆及化学品的贮存库房应严禁火种,当焊补渗漏包装时不得直接用火烧烙铁,应用电烙铁,并搬至库房外安全地点操作。货架或堆垛至少应距采暖设施1m以外。库房内应在门口及其他明显地方粘贴“严禁吸烟”及“严禁明火”字牌,以提高警惕。 4.3.5 隔离存放 油料、油漆及化学品应分类分项存放,化学性质或防护、灭火方法相互抵触的化学品,不得在同一仓库或同一储存室内存放。

企业危险化学品安全管理制度 1 目的和范围 规范危险化学品的管理,保障企业生产安全。 本制度适用于公司范围内危险化学品的生产、使用、运输、采购、销售、储存等环节。 2 编制依据 依据《安全生产法》、《危险化学品安全管理条例》、《广东省安全生产条例》、《危险化学品从业单位安全标准化规范(试行)》制定本制度。 3 职责 3.1 管理部负责编制《危险化学品事故应急救援预案》,定期组织开展演练,并到政府相关部门备案。 3.2 管理部负责开展企业危险化学品登记普查工作,依据普查情况编制《安全技术说明书》和安全标签,负责到有关部门和机构进行登记、备案。 3.3 管理部负责配合企业内开展的各种形式的安全教育,对厂内员工进行危害告之教育。 3.4 公司设立24小时报警、咨询电话。 3.5 各归口管理部门依据《危险化学品安全管理制度》进行安全检查,并相应建立的管理、检查台帐,对相关方进行危害告之,对使用本企业危险化学品的相关方提供《安全技术说明书》。 4 控制程序 4.1 生产和使用 4.1.1 车间应根据生产需要,规定危险物品的存放时间、地点和最高允许存放量。原料和成品的成份应经化验确认。生产备料性质相抵触的物料不得放在同一区域,必须分隔清楚。 4.1.2 生产和使用剧毒物品场所及其操作人员,严格执行企业制定的《剧毒危险化学品安全管理制度》,必须加强安全技术措施和个人防护措施。

4.2 安全技术措施 4.2.1 改革工艺技术,并采用安全的生产条件,防止和减少毒物溢散。 4.2.2 以密闭、隔离、通风操作代替敞开式操作。 4.2.3 加强设备管理,杜绝跑、冒、滴、漏。 4.3 个人防护措施 4.3.1 配备专用的劳动防护用品和器具,专人保管,定期检修,保持完好。 4.3.2 严禁直接接触物品,不准在生产、使用场所饮食。 4.3.3 正确穿戴劳动防护用品,工作结束后必须更换工作服、清洗后方可离开作业场所。 4.3.4 有毒物品场所,应备有一定数量的应急解毒药品。 4.4 压缩气体和液化气体(如:液氯、液氧、乙炔、液化石油气、氧气、二氧化碳、氮气等)使用时,气瓶内应留有余压,且不低于0.05兆帕(Mpa),以防止其它物质窜入。 4.5 盛装腐蚀性物品的容器应认真选择,具有氧化性酸类物品不能与易燃液体、易燃固体、自燃物品和遇湿燃烧物品混装,酸类物品严禁与氰化物相遇。 4.6 易燃物品的加热禁止使用明火,在高温反应或蒸馏等操作过程中,如必须采 用烟道气、有机热载体、电热等加热时,应采取严密隔绝措施。 4.7 生产、使用危险物品,应根据生产过程中的火灾危险和毒害程度,采取必要的排气、通风、泄压、防爆、阻止回火、导除静电、紧急放料和自动报警等措施。 4.8 输送有毒有害物料,应采取防止泄漏的措施。 4.9 输送固体氧化剂、易燃固体等,应防止磨擦、撞击。 4.10 容易发生跑气、跑料的大型易燃、易爆、剧毒物品的装置,应设有能迅速停止进料,防止跑气、跑料的安全设施,并应具有捕集中和、解毒和打捞流失危险物品的方法,避免事态扩大。
