Bilingual Reading(对照阅读)

The Quest

Taking the train, the two friends arrived in Berlin in late October 1922, and went directly to the address of Chou En-lai. Would this man receive them as fellow countrymen, o would he treat them with cold suspicion and question them catiously about their past careers as militarists? Chu The remembeered his age. He was thirty-six, his youth had passed like a screaming eagle, leaving him old and disillusioned.

When Chou En-lai?s door opened the saw a slender man of more than average height with gleaming eyes and a face so striking that it bordered on the beautiful. Yet it was a manl face, serious and interlligent, and Chu judged him to be in his middle twenties.

Chou was a quiet and thoughtful man, even a little shy as he welcomed his visitors, urged them to be seated and to tell how he could help them.

Ignoring the chair offered him, Chu The stood squarely before this youth more than ten years his junior and in a level voice told him who he was, what he had done in the past, how he had fled from Yunnan, talked with Sun Yat-sen, been repulsed by Chen Tu-hsiu in Shanghai, and had come to Europe to find a new way of life for himeself and a new revolutionary road for China. He wanted fo join the Chinese Communist Party group in Berlin, he would study and work hard, he would do anything he was asked to do but return to his old life, which had turned to ashes beneath his feet.

As he talked Chou En-lai stories, Chou smiled a little, said he would help them find rooms, and arrange for them to join the Berlin Communist group as candidates until their application had been sent to China and an answer received. When the reply came a few months later they were enrolled as full members, but Chu?s membership was kept a secret from outsiders.

Lesson 2(E—C)

The story of my life(Ecerpt1)

Heln Keller

The most important day I remember in all my life is the one on which my teacher, Anne Mansfield Sullivan, came to me. I am filled with wonder when I consider the immeasruable contrast between the two lives which it connects. It was the third of March, 1887, three months before I was seven years old.

On thd afternoon of that ventful day, I stood on the porch, dumb, epectant. I guessed vaguely from my moth?s signs and from the hurrying to and fro in thd house that something unusual was about to happen, so I went to the door and waited on thd steps.the afternoon sun penetrated the mass of honeysuckle that covered thd porch, and fell on my upturned face. My fingers lingered almost unconsciously on thd familiar leaves and blossoms which had just come forth to greet the sweet southern spring. I did not know what thd future held of marvel or surprise for me. Anger and bitterness had preyed upon me continually for weeks and a deep languor had succeeded this passionate struggle.

Have you ver been at sea in a dense fog, when it seemed as if a tangible white darkness shut you in, and the great ship, tense and anious, groped her way toward the shore with plummet and sounding-line, groped her way toward the shore with plummet and sounding-line and you waited with beating heart for something to happen? I was like that ship before my education began, only I was without compass or sounding-line, and had no way of knowing how near the harbour was. “Light! Give me light!” was the wordless cry of my soul, and the light of love shone on me in that very hour.

(from Helen Keller, The Story of My Life) 我的生活(摘录)

Lesson 3(C—E)

My life and Literature

(An Excerpt)

Ba Jin

A few days age, a Japanese author asked me how I was able to appreciate authors and books of so many different schools. I replied, “I am not a …man of letters?, nor do I belong to any particular school. Thus I am not restricted in any way.” Then he asked me , “you?ve written many, many books. How can you say you?re not a man of letters?” I replied, “As long as I?m not a man of letters, I?m not subject to any of the rules of literature. Nor do I have to be afraid of being thrown out of any literary circles.” What are my enemies? “All outmoded traditional thinking; any irrational system which obstructs social progress or human development; any force which tramples on love-all these things are my enemies.” All my books were written with the express purpose of denouncing, exposing and striking out at these enemies of mine.

In the twenty years between 1929 and 1948, I wrote very quickly and wrote a great deal. I felt as if my mind was being whipped, as if a ghost had commandeered my pen and was writing to redress the injustices it had suffered. I both cried and laughed along with my principal characters, and often despondently scratched my head.

When I say that I write like I live, and that the highest ideal a work of literature can attain is to be at one with life, and that an author should be able to identify with his raders, I basically mean that books and their authors should never tell lies.

I?ve also said recently on another occasion that the highest state to which art can attain is artlessness. When I was arguing this point with a friend several decades ago, I said, “Physically

attractive people don?t need heavy make-up. Though my writing resembles an ugly monster, it actually looks a little better without any embllishment.” His reply was, “Literary works have stood the test of time because of the skill with which they were written. Who today really cares about the details of what life was like a hundred years ago?”I disagree. Readers are moved by the lifereflected in a story and the fate of the chief characters. This means I oppose fabrication, deception and flowery language. What I hate most are those glory-seeking writers who deceive the public with their lies.

like people who are well prepared. Those who make no endeavor to learn as much about his prospective employer as possible don't have much of a chance of success. Unit4 Professor Huntington's paper greatly inspired me. According to him, in a plural / pluralistic society, there will inevitably be different opinions. The key is to deal with them in such a way that they can play a constructive rather than destructive role. He argues that in a plural/pluralistic society we must stress/attach importance to interper-sonal relationships, cooperation, and looking at issues from the perspective of other people. If some groups regard themselves as superior and treat other ethnic groups or religions with disre-spect, the whole society may be paralyzed. I am convinced that if we put into practice the ideas mentioned above, then there is the possibility of creating a new civilization. Unit5 For my own part. I should certainly hesitate to hire a clerk on his face/appearance alone. Appearances are all too often deceptive. For instance, you might well commit an error in judg-ment if you went by appearances only with people like Edward Hyde Burton, the character created by Maugham. As far as appearance and manners were concerned, Burton seemed a man all of a piece. He was a tiny little fellow with white hair and mild blue eyes. Kind, gentle and candid, he was described by many as one of the most respectable people on earth. Nevertheless, he turned out to be cruel to a friend in need of his help. He insulted and fooled Turner who was down and out and made him commit himself to an insane venture. What was still more surprising Unit6 There is no question that today we are under constant pressure to work longer hours, to produce more, to possess more, and to become a success. Workaholism, a modern addiction, has thus arisen. The cause of workaholism is the perception that by working longer hours and com-pleting more projects, we will enhance our self-worth. Many women today feel the same stress to produce and get ahead and, at the same time, to nurture their offspring and shoulder a variety of domestic responsibilities. Research shows that workaholism tends to distance us from our immediate families. It forces us to labor longer and longer hours, leaving a minute fraction of time to be physically and emotionally available to our loved ones. Intimacy among family members is doomed to die in the process. Unit7 A severe earthquake occurred all of a sudden at 10a.m. yesterday in a rural area, about 200 kilometers east of the city. Initial reports coming out of the region indicate the earthquake has caused widespread devastation/damage and heavy casualties. Many adolescents were among those injured or killed. Yet it remains obscure exactly how many people were hurt and killed as the entire area has been enveloped in rubble. However, one thing is certain: many of the survivors may face years of pain and suffering. Local people were clearly shaken by this reminder of their mortality. Some religious ones have gathered to pray that it will never recur. Unit8 Last Wednesday my classmate Caroline and I visited Zhouzhuang, a well-known town looped all around by streams. When we arrived at the town, Caroline was so excited that she darted towards the first bridge she saw and began singing loudly there. Suddenly her voice hushed when she found that she had startled a flock of ducks not too far from us. Now as Caroline was dying for a boat ride, we decided to tour the town by boat. Now loud, now soft, Caroline talked to all the creatures in the stream and was fussing about everything while I looked at the boats gliding over the water in all silence. Though we did not see anything spectacular, we enjoyed every minute in the town that lies out of the range of the heavy traffic and noise of the large city. Zhouzhuang is worth visiting and, time permitting, I'd like to go there again.

It also indicates what is evil and wrong, and should not and may not be done.

练习1:外国合营者如果有意以落后的技术和设备进行欺骗,造成损失的,应赔偿损失。If the foreign joint venturer causes any losses by deception through the intentional use of backward technology and equipment, it shall pay compensation for the losses. 修改提示:单复数考虑不周;用语不够简洁。 答案(修改要点):causes any losses →causes any loss(es) 造成一项或多项损失时都应当赔偿,不能仅用复数形式。 pay compensation for the losses →pay compensation therefor (therefor=for that/them) 练习2:人民法院、人民检察院和公安机关办理刑事案件,应当分工负责,互相配合,互相制约,以保证准确有效地执行法律。 原译文:The people’s courts, people’s procuratorates and public s ecurity organs shall, in handling criminal cases, divide their functions, each taking responsibility for its own work, and they shall co-ordinate their efforts and check each other to ensure correct and effective enforcement of law. 修改提示:“分工负责”,应理解为:侧重点在“负责”,而非“分工”,即分工过程中各负其责;respective 比own 更为妥当、准确;原来的译文中,and they shall …比较啰嗦,更严重的问题是,使to ensure …割断了与divide their functions 的联系。 答案(修改要点):in handling criminal cases, divide their functions, each taking responsibility for its own work, and they shall co-ordinate their efforts and check each other to ensure correct and effective enforcement of law.→… in handling criminal cases, take responsibility for their respective work while dividing functions, co-ordinate, and check each other, to ensure correct and effective enforcement of law. 练习3:商标注册人享有商标专用权,受法律保护。 原译文:Trademark registrants shall enjoy the right to exclusive use of their trademarks and shall be protected by law. 修改提示:商标专用权的译文“貌合神离”,立法原意是“商标专有权”;受法律保护的主语有些歧义,可加括号处理;原文shall滥用,因为并未刻意强调“必须,一定要”。 答案(修改为):Trademark registrants have the exclusive trademark right, (and are) protected by law. 练习4:被告人的犯罪情节极其严重、社会影响极其恶劣、社会危害极其严重。 原译文:The extremely serious circumstances of the offense committed by the accused have brought abominable influence and severe hazard to the whole society. 修改提示:bring的用法有些生硬,动宾搭配不太适当。 答案(修改为):have brought abominable influence and severe hazard to the whole society. → have exerted an abominable influence and posed a severe hazard to society. (exert, vt. 施加,产生,如exert pressure on, exert an influence on; abominable, adj. 可恶的,极坏的;pose v. 提出,形成,成为;使摆好姿势pose a problem; pose an obstacle/a threat to …) 练习5:买卖双方同意按下列条款由卖方出售,买方购进下列货物:货号; 品名及规格;数量;单价;总值(数量及总值均有_____%的增减, 由卖方决定);生产国和制造厂家;包装;唛头;装运期限;装运口岸;目的口岸;保险;

1、(1)、The Conformity Certificate of the Goods to be delivered shall be delivered directly to Party A by Party C on the Delivery Day of such Goods. (2)、When the Goods to be pledged under this Agreement have been delivered to the Dealer acting on behalf of the Pledgee, the Pledgor shall submit to the Dealer a Delivery Note. (3)、Unless otherwise specified in writing herein, all Confidential Information must be returned to the disclosing Party or destroyed on the expiration of the period of the receiving Party’s using such Confidential Information. Where the disputes arising out of or in relation to this Contract can not be resolved within fifteen (15) days after any Party hereto requesting in writing the other Party to commencing a consultation on said disputes, either Party may submit it to the China International Economic and Trade Arbitration Commission for arbitration(CIETAC). Any losses suffered by any Party hereto arising from any breach shall be indemnified by the Party in breach. 2、(1)、If any of the provisions of this Contract is held invalid or unenforceable and unless the invalidity or unenforceability materially violates the fundamental intent and sense of other parts of this Contract, such invalidity or unenforceability shall not affect the validity and enforceability of any other provisions hereof.

Legal English (revised version for the students) Ch.1 The Main Features of Legal English 一、法律英语的英译: David Mellinkoff(加州大学洛杉矶分校法学院教授):《The Language of the Law》1963 1.legal English---Lawful English Legal parlance(说法、用语)/legal lingo(行话、隐语)/legal jargon(行话、黑话)/legalese( 法律八股文)/language of jurisprudence(法理语言) 2. the English Language of the Law or shortened as “the language of the law” 3. 实务中鉴于对法律文件中文字的理解不一,也是常有纠纷出现: e.g. The Charter required that directors “shall be elected on a vote of the stockholders representing not less than two-thirds of outstanding capital st ock of the corporation.” 甲方理解成:被选上董事的人需三分之二的股东投票赞成(a candidate to be elected needs the votes of two-thirds of the stockholders ) 乙方则认为:选董事时须有三分之二的股东出席(two-thirds of the stockholders must be present at the meeting at which the election is held) What’s the judge’s opinion? e.g. 一个阿肯色州的美国人临终前写了一个遗嘱,遗嘱写道: The remainder of the testator’s property should be “divided equally between all of our nephews and nieces on my wife’s side and my niece.” 重复使用具有绝对含义的词汇,如all , none, perpetuity, never, unavoidable; 3.
