第一条根据《中华人民共和国劳动合同法》等有关规定，甲乙双方本着遵循合法、

公平、平等自愿、协商一致、诚实信用的原则，订立本劳动合同，共同遵守履行。

Article 1 The contract is hereby concluded by both parties in accordance with

Labor Law of the People's Republic of China and Labor Contract Law of the

People’s Republic of Chin a, in the principles of fairness, legitimacy,

equality, voluntariness, consensus through negotiation and good faith.

第二条合同期限

Article 2 Contract Term

劳动合同期限经双方约定，采取下列第种形式。

（一）固定期限：自年月日起至年月日止。

（二）无固定期限：自年月日起至法定解除或终止劳动合同条件出现

时止。

（三）以完成一定工作任务为期限：自年月日起至工作任务完成为止。

第三条工作内容与工作地点

Article 3 Job Responsibility and Work Place

(1) 甲方聘用乙方从事岗位工作。

(2) 工作地点为。根据甲方工作需要，经甲乙双方协调一致，可变更工作地点。

(3) 乙方应积极遵守公司所有规章制度，按质、按量、按时完成其本职工作。

（4) 甲方可以根据实际工作需要，根据乙方的工作能力和表现，调整乙方工作岗位或安排乙方临时从事其他工作岗位，乙方应予以认可配合。

（5）甲、乙双方同意按以下方式确定乙方的工作时间：

□标准工时制，即每日工作小时，每周工作天；

□不定时工作制；

□综合计算工时工作制，乙方所在岗位实行以周期，总工时小时的综合计算工时工作制。

第四条劳动报酬与福利待遇

Article 4 Labor Remuneration and Welfare

（1）甲方每月日以货币的形式足额支付乙方工资，结算周期为上月月初到上月月末，实行先工作后发薪的制度。

（2）乙方正常工作基本月薪为元（人民币/美元/英镑），汇率以支付当日为准。根据公司经营状况和乙方工作表现，乙方工资及奖金可另行调整。

（3）甲方按照中国有关规定对乙方所应承担的社会保险费用及个人所得税进行代扣代缴。按照乙方工作所在地国家规定所应支付的相关税费由乙方自行承担。

(1) Party A shall pay off salary to Party B in currency on the of every month. The pay period is from the beginning to the end of last month. Party B works before paid.

(2) Party B’s normal basic salary is in RMB/USD/GBP at the exchange rate to the payment date. The basic salary can be adjusted as per the company’s operation and Party B’s performance.

(3) Party A will deduct Party B’s social insurance premium and individual income tax from his or her salary according to the law and regulation of China. And Party B should afford the relevant taxes and fees in accordance with the law and regulation of the workplace.

第五条劳动合同的履行与变更

Article 5 Contract Performance & Alternation

（1）甲方应按照约定为乙方提供适当的工作场所、劳动条件和工作岗位，并按时向乙方支付劳动报酬。乙方应当认真履行自己的劳动职责，并亲自完成本合同约定的工作任务。

（2）甲、乙双方协商一致，可以变更本合同内容，并以书面的形式确定。

(1) Party A shall furnish Party B with proper working place, labor conditions and position, and shall also pay the remuneration to Party B on time, conforming to the provisions herein. Party B shall fulfill his responsibilities herein in due diligence.

(2) The contract may be revised in written form, after both parties’ agreement through negotiation.

第六条合同的解除和终止

Article 6 Contract Cancellation and Termination

合同期满双方不再续签或者双方约定的合同终止条件出现时，雇佣合同即终止。

经合同双方当事人协商一致，本合同可以解除。

（3）乙方应遵守中国政府的法律、法规及有关规定，乙方如违反上述规定，甲方有权即时解除合同；乙方因健康原因，经医生证明连续病休15工作日后仍不能继续工作，甲方有权提前终止合同。

(4) 乙方因归国或其他私人原因未正常出勤且超过十天且未向甲方做出书面说明的，本合同自动终止。

(5) 乙方被证明无法完成本合同项下的工作任务，甲方有权随时解除本合同。

(6) 乙方应严格遵守甲方的工作规定以及规章制度，尽职尽责，否则，甲方有权随时解除合同并追究因此而造成的经济损失，并有权对所造成的经济损失在乙方的报酬中作相应扣除。

(7) 乙方有权提前30 日以书面形式通知甲方解除本合同，在试用期内提前3日通知甲方即可解除。

(1) This contract shall be terminated once it expires and both parties do not extend the contract.

(2) The contract may be canceled based on both parties’ mutual negotiation.

(3) Party B should abide by China laws, decrees and related regulations and Par ty A’s working systems. During the duration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminate the contract before expiration in case Party B cannot resume his or her work for health reasons after the medical certification of continuous sick rest for 15 working days.

(4）The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.

(5) In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel the contract at any time.

(6) Party B should abide by Party A’s working systems, rules and regulations. Otherwise, Party A is entitled to cancel the contract and claim a corresponding compensation of any economic loss from Party B’s pa yment.

(7) Party B should inform Party A in written form 30 days in advance for canceling the contract, and 3 days in advance during the probation period.

第七条其他事项

Article 7 Others

（1）其他未尽事宜，双方可参照甲方公司内部的相关规章制度执行，或者可由甲、乙双方另行订立补充条款，补充条款与本合同具有相同的法律效力。

（2）甲乙双方均应遵守本合同之约定，任何一方违约，非违约方均有权要求违约方承担相应的损失。

（3）在合同履行中，发生其他事项而本合同未明确的，按中国有关法规执行。

（4）本合同分为中英两种文本，每种文本具有相同的法律效力；如两种文本产生冲突，则中文文本为作准文本。

（5）本合同一式两份，甲、乙双方各执一份，每份具有同等法律效力。本合同经甲、乙双方签字盖章后生效。

(1) Other items not stipulated by the two parties can be implemented according to the internal rules and regulations of Party A; or both parties may conclude

a supplement clause and the clause shall have the same effect as this contract.

(2) The two parties should abide by the contract. In case one party tears up the contract, the other party has the right to require the defaulting party to undertake corresponding loss.

(3) If there is something undefined in this contract when implementing this contract, it shall be executed according to relevant laws and regulations of China.

(4) The contract has two versions in Chinese and in English. The two copies are equally authentic. In case any dispute happens, the Chinese version shall prevail.

(5) The contract is in duplicate, held by Party A and Party B respectively. The two copies are equally authentic. The contract comes into effect upon signatures or seals of both parties.
