对我国产品缺陷问题的探讨 摘要：产品责任是由产品缺陷导致消费者人身、财产损害所产生的民事责任，因此产品存在缺陷是构成产品责任的一个必备要件。产品缺陷的相关问题，不仅是诉讼中当事人争执的焦点，也是法官关注的焦点，更是实现责任控制、防止过度归责的一道“安全闸”。从产品缺陷的概念、分类以及认定的法理依据着手，我们可以逐步分析产品缺陷问题，这对解决我国产品责任法存在的问题大有帮助。 关键词：产品缺陷；产品瑕疵；不合理危险 一、产品缺陷的含义 （一）产品缺陷的定义 1.国外相关立法中的“产品缺陷” 有关产品责任诉讼的第一个案例发生在英国。从此以后，西方社会的产品责任法律制度不断完善。特别是第二次世界大战以后，西方国家纷纷制定有关产品责任的完整法律。如1979年美国《产品责任示范法》，美国的产品责任法发展比较早，也比较典型，其他西方国家也有这方面的法律或判例。 2.我国关于“产品缺陷”的立法 《中华人民共和国产品质量法》第46条规定，产品存在缺陷是指产品存在危及人身、他人财产安全的不合理的危险；产品有保障人体健康、人身、他人财产安全的国家标准、行业标准的，是指不符合该标准。 我国在立法上采用了双重标准。第一，考虑产品是否具有不合理危险；第二，生产标准。但在实践中，极有可能出现产品符合国家标准、行业标准，但却具有不合理危险的情形，因此认定产品不合理危险的标准存在着冲突。关于产品符合国家标准、行业标准，但仍因不合理的危险造成消费者人身或财产损害时，生产者或销售者应当负担的损害赔偿责任，《产品质量法》规定得并不明确。 二、缺陷产品的认定 （一）产品责任认定的一般构成要件： 产品责任依其构成，须具备以下要件：（1）须有缺陷产品；（2）须有人身、财产的损害事实；（3）须有因果关系，即产品的缺陷与受害人的损害事实之间存在着引起与被引起的关系，产品缺陷是原因，损害事实是结果。现代社会大多数国家对产品责任适用严格责任，产品缺陷是承担产品责任的基础，也理所当然成为产品责任法的核心。 （二）我国关于“产品缺陷”的认定 我国《产品质量法》把“不合理危险”作为认定缺陷的判断标准。考虑产品是否具有“不合理危险”，应考虑以下几个因素：（1）生产者制造产品的预期用途。即考虑一个合理谨慎的生产者知道（或应当知道）其产品的危险时，会不会将其投入市场；（2）一个具有社会一般认识的普通消费者，对其购买使用产品安全性的合理期望。如果某一种危险是一般消费者意识到，但仍愿意承担者，这不属于“不合理危险”；（3）如果由于认识和技术水准所限，不能在产品效用不变的前提之下，将其制作的更安全或其他之替代品，应该认为这些产品不具有不合理危险。（4）若产品的各项性能与标准都符合强制性标准时，不能就此认定不具有不合理之危险。 我国《产品质量法》还规定了认定缺陷的另一个标准——生产标准，如果产品不符合保
