8.weighing,samplingandmoistureDetermination

8.1ThecargoshouldbeinspectedbyInTeRTeKatloadingport whencargoisshipping.Thebuyer

saccount.sellershouldnotifythebuyerbeforehandbyfaxo remailof

theindependentinspectorspecifiedinthecontract.货物出运前，买方授权InTeRTeK代表买方

在装载港检测货物，卖方承担检测费用并须预先通过传真或邮件通知买方检测日期，代表合同上

8.2Forthepurposeoffinalsettlement,weighing,sampling andmoisturedeterminationshallbe

carriedoutforthebuyersaccountatthedischargeportorth ereceivingsmelter,inbuyer’

soption,bycIQ/ccIc,inaccordancewithstandardinternat ionalpractices.weighingwillbedeterminedbyscaleweigh tatthedischargeportorthereceivingsmelter,inbuyer’soption,withcostsforbuyer’

saccount.Thesellerhastherighttobepresentattheseoper

ationsbyasurveyororrepresentative,actinginnameandon behalfoftheselleratitsownexpense.Thesamplelotsizesh allbeapproximatelyper100wmTandeachlotshallformasepa rateandcompletedeliveryforthepurposesofsettlementof weightandmoisturecontent.Theresultsobtainedshallbef inalandbindingonbothparties.Representativesamplessh allbetakenfromeachlotwiththefollowingdistribution: 出于最终结算目的，称重，取样和湿度测量应该在卸货港由cIQ/ccIc依据国际标准惯例进行操作，买方承担费用。称重应该在卸货港由cIQ/ccIc以及买方的代表一起通过水尺测定，买方承担费用。卖方有权参与这些操作过程，或者有权指定检测人员或代表以卖方名义参与这些操作，由此产生的费用由卖方自行解决。每100湿吨需取一个样，每个样品应为一个独立完整的可作为水份和含量最终结算用的样品，次结果对双方都产生约束力。代表样应从上述每批样品中取出并按照如下方式分配：

-onesetofsealedsamplesforbuyer一份经封样的样品由买方保管

-onesetofsealedsamplesforcIQ/ccIc一份经封样的样品由cIQ/ccIc保管

-onesetofsealedsamplesforseller一份经封样的样品由卖方保管

-onesetofsealedsamplestobekeptincIQ/ccIcappointedco njointlybybothpartiesforeventualumpirepurposes。一份经封样的样品由cIQ/ccIc保管供双方仲裁用

Allsamplesshallbesealedandsignedjointlybybothbuyera ndseller’srepresentative.

以上提及的所有样品必须由cIQ/ccIc和买方和卖方的代表共同封样并签名。

Theresultshallbeexchangedbysellerandbuyerwithin60da ysafterthesamplestakenatthereceivingsmelter.卖方与买方可在取样后的60天之内交换双方结果。

AllZincconcentrateslostordamagedafterriskhaspassedt othebuyerinaccordancewithArticle11,willbetreatedasi ftheyhadbeensafelydeliveredtothebuyerforthepurposes ofdeterminingwhethertheobligationofthesellertodeliv erandsell,andtheobligationofthebuyertobuyinaccordan cewithArticle2hasbeenfulfilled在交货后所有锌精矿损失或者损坏买方将依据条款11.
