6.It is highly unlikely that the death penalty will ever operate so effectively as to save many more lives

than other less severe punishments. Yet given its defects it would have to save many more lives in order to be a genuine candidate for moral legitimacy. Fortunately all of this is merely hypothetical. We have no reason to believe that the death penalty does save more lives than other punishments and so we need not actually confront this choice.
